Shall the commission:
133. Authorize the executive director to sign a cost sharing partnership with Whatcom County for licensed Pictometry imagery and software? At the Whatcom County Council meeting on 11/7/2012, vote #180, the executive was authorized to sign a $123,727 contract with Pictometry International Corporation of Rochester, N.Y, to provide digital aerial imagery of Western Whatcom County. The cost-shared partnership with 15 jurisdictions will provide a lower cost to all parties. The total cost to the port is $8,000. (2655/Consent Agenda 1) Approved 3-0
134. Approve a new lease with NW Explorations for 1,940 square feet at the Marine Square building? The business is expanding to include a show room to display its retail products as well as a shop area for electronic repairs and installation and a tool parts repair area for servicing its fleet of vessels. The five-year lease will begin on 10/1/2013 and end on 9/30/2018 with the three five-year options. (2646/Action Item 1) Approved 3-0
135. Authorize the executive director to sign a $436,700 contract (amendment #1) with Landau Associates of Edmonds to conduct a remedial investigation/ feasibility study of the Westman Marine site in Blaine? Previous environmental investigations have documented metals contamination in marine sediment. The state has listed the site at the top of the Model Toxics Control Act priority list. The original contract for $132,000 was approved at the 10/4/2011 meeting, vote #149. This amendment brings the total contract to $568,700. (2647/Action Item 3) Approved 3-0
136. Authorize the executive director to award the low bid of $721,334 to Interwest Construction of Burlington for phase one of the Squalicum Creek delta project? The major components of the estuary restoration project are: removal of fish passage barriers, modification of two bridges, removal of the concrete bottom between the two bridges and replacement of a sewer trunk line. The state, city of Bellingham and Whatcom County have made commitments of $2,485,000 to fund the project. The estimated cost of the entire project is $3,500,000. A contingency fee of $72,133 brings the total contract to $793,467. The work was advertised and four bids were received. (2648/Action Item 4) Approved 3-0
137. Authorize the executive director to sign a $40,400 contract (amendment #6) with Anchor QEA of Seattle to perform construction management services for phase one of the Squalicum Creek delta project? This project will help restore Bellingham Bay. At the 7/6/2010 meeting, vote #103, Anchor QEA (formerly Anchor Environmental) was authorized to produce a conceptual plan for major components of the project: habitat enhancement of the creek estuary, modification of two bridges, removal of the concrete bottom between the two bridges and replacement of a sewer trunk line. This amendment brings the total contract to $582,587. (2649/Action Item 5) Approved 3-0
138. Authorize the executive director to sign a $550,000 contract (change order #19) with Dawson Construction of Bellingham for phase 2 of the airport expansion project? The original contract for $16,961,834 was approved at the 2/21/2012 meeting, vote #26. This order pertains to the changes requested by the Transportation Security Administration ($320,000), asbestos removal ($90,000) and tenant relocation ($95,000). This change order brings the total authorized contract to $18,524,041. (2650/Action Item 6) Approved 3-0
139. Allow the Hempler Foods Group (formerly B. B. Meat and Sausage Company) to sell up to $3,875,000 in tax-free bonds to expand the Ferndale facility? At the 7/18/2006 meeting, vote #89, the port commission allowed Hempler to sell $6,125,000 million in tax-free revenue bonds for a new facility. This application will bring the bonding cap of $10 million. (Industrial Development Corporation Resolution 74) Approved 3-0
140. Allow the Hempler Foods Group to sell up to $3,875,000 in tax-free bonds to expand the Ferndale facility? Hempler currently employees 71 and expects to add 14 new jobs. 2651/Action Item 7 (Resolution 1321) Approved 3-0
141. Authorize the executive director to apply for a $1 million grant and a $2 million loan from the Whatcom County Economic Development Investment Board? The loan will help fund the “C” Street Terminal Upland Infrastructure Rehabilitation project. The $3 million loan grant will fill a funding cap in the $12.4 million project. The Economic Development Investment Board is funded by a sales tax rebate. The board was created by the Whatcom County Council to make recommendations to the council on local economic development projects. (2652/Action Item 8) Approved 3-0

Shall the commission:
142.Authorize the executive director to close the existing Whatcom Waterway grant agreement (amendment #6) and sign a new grant agreement with the state of Washington? At the 4/16/2013 meeting, vote #71, the commission requested that the state shift $3,800,000 in Whatcom Waterway grant money to the Central Waterfront. The port and the state staffs agreed for convenience and funding purposes that closing the existing agreement and opening a new agreement was the best approach. (2679/Action Item 1) Approved 3-0
143. Authorize the executive director to award the low bid of $155,398 to P&P Excavating of Bellingham for two boat launch upgrades and three sidewalk maintenance projects? Two boat launch facilities in Blaine and Fairhaven will be upgraded with piping and valves to divert rinse water into the sewer. Sidewalks along Coho Way and North Harbor Loop Drive will be replaced. The work was advertised and four bids were received. A contingency fee of $23,310 brings the total contract to $178,708. (2680/Action Item 2) Approved 3-0

144. Authorize the interim executive director to renew the port’s liability and auto insurance coverage? The premium will be $150,131 (10/1/2013 to 9/30/2014) and the broker is Alliant Insurance Services of Newport Beach, Calif. The premium is 6.6 percent or $9,333 above 2012-2013 coverage. The port’s property insurance coverage was approved at the 7/2/2013 meeting, vote #107. (2696/Consent Agenda B) Approved 3-0
145. Authorize the executive director to sell surplus vehicles and equipment at public auction? Items with an estimated value of more than $1,000 are: Wisconsin tilt bed trailer $3,000; Ford five ton dump truck $5,000; 1968 30kw generator $5,000; two John Deere mowers $2,000 each; 1968 100kw generator $8,000; and 1994 GMC one ton truck $1,500. The total estimated value of the surplus items is approximately $29,855. 2697/Consent Agenda C (Resolution 1322) Approved 3-0
146. Authorize the executive director to sign the 2013-2015 Associate Development Organization contract with the state of Washington? The state legislature created the Associate Development Organization in 1993 to support local economic development. Since 1993, the Northwest Economic Council has served as the lead economic development organization in the county. Responsibilities were transferred to the Port of Bellingham at the 3/6/2012 meeting, vote #44. The port will be reimbursed $104,069 per year for economic development services. 147. Renew a lease with Minga, Inc. (d/b/a Kuru Kuru Sushi)? The lease for 2,000 square feet at #11 Bellwether Building, suite 101 is five years with two five-year options. The rent in the 2008 lease was below rental revenue standards. To bring the rent closer in line with rental standards it will be increased 16 percent over the five-year lease. 148. Modify and renew a lease with Bella Marina LLC (d/b/a Nick’s Bella Marina)? The lease is for approximately 7,683 square feet at the Squalicum Esplanade. The renewal runs from 10/1/2013 through 9/30/2018. The lessee has committed to invest $200,000 in tenant improvements. The floor covering will be replaced within 90 days of the signing of this renewal lease. (2701/Action Item 4) Approved 3-0

149. Authorize the sale of two vessels for the nonpayment of moorage fees? An auction was held on November 7 for a 22-foot fiberglass sailboat with a moorage fee of $1,806 and a 26-foot fiberglass sailboat with a moorage fee of $1,735; neither was sold. (2708/Consent Agenda B) Approved 3-0
150. Authorize the executive director to sign a $73,800 contract (amendment #5) with Anchor QEA of Seattle for supplemental action on the remedial investigation of the Central Waterfront site? The original contract was approved at the 5/14/2012 meeting, vote #90. The site is approximately 55 acres of industrial property, used for bulk fueling, boat yard operations, rock crushing and municipal waste disposal. This amendment is for construction management and preparation of an interim action report. This site falls under the Model Toxics Control Act making 50 percent of cleanup costs eligible for state grants. This amendment brings the total contract to $532,730. (2711/Action Item 1) Approved 3-0
151. Grant the city of Bellingham a temporary easement to complete an interim cleanup at the R.G. Haley site? Contaminants were first observed leaking from the site in 2001. The cleanup project will remove approximately 40 wood pilings and contain an intermittent petroleum seep using organophilic clay. The six-acre site is located on the waterfront at the south end of Cornwall Avenue. Of the 5,137 square feet in the cleanup area, 1,662 square feet fall within port management.
