Action Taken at February 7, 2012 Meeting

Shall the commission:

18. Authorize the executive director to sign the mutual use of facilities agreement with the city of Bellingham to include more properties? The new agreement allows each agency up to three free uses per year of the other’s facilities. The Port of Bellingham can use the following city facilities: Elizabeth Park gazebo, Maritime amphitheater and Fairhaven Village Green, Civic Field stadium, Joe Martin baseball field, museum rotunda, Bloedel Donovan and Fairhaven Park indoor facilities and Bellingham Library facilities. (Consent Agenda B) Approved 3-0

19. Approve a supplemental lease agreement with the federal government? A five-year lease with U.S. Customs was first approved at the 1/8/2002 meeting, vote #5. The lease was for 1,745 square feet of space at the Bellingham airport arrivals building; U.S.Customs was consolidating their several county locations into a single one. The lease was renewed at in June 2007; it will expire on 6/1/2012. This supplement agreement extends the lease for two years (6/1/2014) until the terminal expansion project is completed. (Action Item 1) Approved 3-0

20. Authorize the executive director to sign a $274,922 contract (amendment #1) with Anchor QEA of Seattle to finish the remedial investigation/feasibility study (RI/FS) ot the I&J Waterway? The waterway is one of the Bellingham Bay Model Toxics Controls Act sites. At the 11/16/2004 meeting, vote #117, the commission approved a $249,470 contract for the RI/FS project. In 2007, the state temporary suspended the project. At the 3/3/2009 meeting, vote #40, the commission approved an $18,006 contract with Anchor QEA to complete the study. This amendment is based on a revised work plan. A contingency fee of $54,984 brings this contract to $329,906 and the total amended contract to $347,912. (Action Item 2) Approved 3-0

21. Renew and modify a lease with Chris and Heather Lange d/b/a Coffee Junction at the Fairhaven Station? The original 1995 lease was with Ikolea and Laura Jefferts d/b/a/ Fairhaven Coffee and News. In 1998, the lease was with Julia J. Wrucha d/b/a/ Fairhaven Coffee and Tea. The lease with Chris and Heather Lang was first signed in 2006. (Action Item 3) Approved 3-0

22. Modify a lease with Scotty Browns restaurant? At the 7/19/2011 meeting, vote #108, the commission approved a five-year lease with the restaurant doing business inside the secured section of the Bellingham airport terminal building and that it be open for business no later than 3/1/2012. Because of unforeseen obstacles and delays the restaurant will open on or before 6/15/2012. (Action Item 4) Approved 3-0

23. Approve a lease with Trailhead Athletics, Inc at Marina Square? Trailhead Athletics is a personal fitness training and exercise business. The two-year lease for 2,000 square feet will start on 3/1/2012 and end on 2/28/2014. The base rent does not meet the rental revenue standards; if renewed the revenue standards will start in year three. The lease meets the 2012 strategic goal of maintaining high occupancy levels, consistent revenue and job opportunities for the community. (Action Item 5) Approved 3-0

24. Approve a lease modification with Greenberry Industrial of Corvallis, Oregon? At the 10/4/2011 meeting, vote #143, the commission approved a lease with Greenberry Industrial for approximately five acres of land and a 45,000 square foot warehouse space at the Bellingham Shipping Terminal. This modification will add approximately 46,500 square feet of outside storage area starting on 2/1/2012 and ending on 5/31/2012. Superior Energy Services Marine Division is partnering with Greenberry Industrial to provide oil field services in Alaska. The additional property will add more than seven acres to the leased premises. (Action Item 6) Approved 3-0

Action Taken at February 21, 2012 Meeting

Shall the commission:

25. Authorize the executive director to sign an agreement for not over $25,000 with the Port of Tacoma for assistance in obtaining federal permits for new and existing projects? The agreement will allow the Port of Bellingham to take advantage of agreements the Port of Tacoma has with the National Oceanic and Atmospheric Administration’s National Marine Fisheries Service and the U.S. Fish and Wildlife Service. The Port of Bellingham has a number projects that will require the acquisition of federal permits. The first project will be cleanup of the Whatcom Waterway site. (Action Item 1) Approved 3-0

26. Authorize the executive director to award the low bid of $16,154,128 to Dawson Construction of Bellingham for phase two of the Bellingham airport terminal expansion project? At the 10/19/2010 meeting, vote #143, the low bid of $7,116,515 was awarded to Tiger Construction of Everson for the first phase of the expansion project. Phase one expanded the building from 27,000 square feet to 47,000 square feet. The second and final stage will consist of approximately 60,000 square feet of new construction and remodeling the original 27,000 square foot building. A contingency fee of $807,706 brings the total contract to $16,961,834. The work was advertised and six bids were received. (Action Item 2) Approved 3-0

27. Authorize the executive director to sign all permits not to exceed a total of $90,000 for the Bellingham airport terminal expansion project? The fees are paid to Whatcom County; not all the fees have been calculated at this time. (Action Item 3) Approved 3-0

28. Authorize the executive director to sign a $794,704 contract (amendment #6) with URS Corporation of San Francisco to perform 2012 construction management services for phase two the Bellingham airport terminal expansion project? URS has been involved in the design of the building and performed construction administration for phase one of the terminal expansion project. Construction management for 2013 will be approved at a later date. The original contract was approved at the 3/3/2009 meeting, vote number 47 and amended at the 4/6/2010 meeting, vote number 62; 6/1/2010 meeting, vote number 95; 8/17/2010 vote number 104; 11/2/2010 meeting, vote #154 and 8/16/2011 meeting, vote #124. This amendment brings the total contract to $4,804,914. (Action Item 4) Approved 3-0

29. Authorize the executive director to sign a $98,370 contract with Geo Test Services of Bellingham to perform special inspections for phase two of the airport terminal expansion project? The building permit issued by Whatcom County requires special inspections for gravel and asphalt compactness, concrete strength and flatness, high-strength bolting testing, fabricated steel and field welding inspections. A contingency fee of $9,837 brings the total contract to $108,207. (Action Item 5) Approved 3-0

30. Authorize the executive director to sign a $10,000 contract (amendment #2) with Faber Construction of Lynden to bring a water system into code compliance? A city inspector at 300 Harris Avenue didn’t discover a code error until after the system had been installed. Whole sections of the restroom walls could not be closed until the non-potable system was reworked. The city responded to a question of financial responsibility be waiving the fee for the temporary occupancy permit. This amendment brings the 300 Harris Street building improvement project to $2,439,100 and the overall project budget to $2,950,000. (Action Item 6) Approved 3-0

31. Authorize the executive director to sign a $22,052 contract (amendment #4) with CH2M Hill of Englewood, Colo. for the Slater Road wetland mitigation project? The U.S. Army Corps of Engineers issued a permit (11/16/2010 meeting, vote #161) allowing 8.9 acres at the airport to be filled for the terminal building expansion project. Approximately 37 acres of wetland will be created on state property on Slater Road adjacent to unnamed tributaries of Spring Creek. This amendment will complete the design, permitting and support for the phase one of the project. The construction costs for phase one is estimated to be $1.1 million. This vote brings the total amended contract to $342,675. (Action Item 7) Approved 3-0

32. Authorize the executive director to sign a $41,720 contract (amendment #1) with URS Corporation of San Francisco for the Bellingham apron rehabilitation and reconstruction project? The original contract for $177,162 was approved at the 10/18/2011 meeting, vote #156. The existing de-icing system will be converted to a system that will capture fuel that may be spilled during re-fueling. It will also add concrete pavement for a plane wash station in the general aviation area and a spill containment slab in the fuel truck parking area. This vote brings the total amended contract to $241,720. The federal government (FAA) will reimburse the port for 95 percent of the cost. (Action Item 8) Approved 3-0

33. Authorize the executive director to sign an agreement with the city of Bellingham and Whatcom County for the West Bakerview overpass project? The Port of Bellingham will contribute $500,000 to the $3.2 million project with $250,000 contributed in 2012 and $250,000 in 2013. The city of Bellingham received a state grant for $1.5 million, a $650,000 grant/loan from the EDI (see the County Council meeting on 12/6/2011, vote #218), $100,000 each from Whatcom County, Fred Meyer and the state Department of Transportation and remainder from the city of Bellingham. (Action Item 9) Approved 3-0
