Action Taken at November 1, 2011 Meeting
Shall the commission:
158. Authorize the executive director to award the low bid of $75,939 to Pacific Western Lumber of Lake Oswego, Oregon, for treated timber to repair piers? On 2/5/2008, a tug and barge struck a pier at the Bellingham Shipping Terminal and the Arrowac pier was damaged by wind and cold weather on 11/20/2010. The port advertised for pilings and received five bids. (Consent Agenda D) Approved 3-0
159. Amend a lease with Bellwether Gate, LLC for Building C (amendment 2) at Bellwether on the Bay? The Bellwether Gate project comprises four building with underground and surface parking. The construction of Building A is completed and the the construction of Building B is expected to be completed by the end of 2011. Building C is a two-story building with about 10,000 square feet and will be located near Anthony’s restaurant. A tenant has been secured for at lease one floor so the building will be completed soon than anticipated so this amendment will change the completion date from October 2012 to June 2011. (Action Item 1) Approved 3-0
160. Authorize the executive director to modify a contract with Faber Construction of Lynden for improvements to the building at 300 Harris Avenue? The building is being upgraded (11/16/2010 meeting, vote #159) for Index Industries, The 35-year-old company currently manufactures switches, sensors and controls for industrial vehicle, engine and equipment markets in Stanwood. The contract allows the tenant to select upgrades to the approved contract but shall be responsible for the cost increases. Index Industries is requesting upgrades of approximately $20,000. Action Item 3) Approved 3-0
161. Renew and modify a lease with Pacific Cruises Northwest, Inc. d/b/a Victoria/San Juan Cruises? Pacific Cruises Northwest has been operating out of the Bellingham Cruise Terminal since June 18, 1991. The latest lease expired on October 21, 2011. This renewal and modification provides for a one-year extension with four one-year renewal options. It deletes the d/b/a references to “Victoria,” reduces the size of the leased premises and rents. (Action Item 4) Approved 3-0

162. Adopt the 2012 strategic budget? (Resolution 1303) Approved 3-0
163. Adopt the 2012 property tax levy? The 2012 property tax levy is 29 cents per $1,000 of assessed valuation and tax income estimated at $6,719,000. The revenue decrease from 2011 is estimated at $333,142. When the county assessor provides a final property assessment, staff will prepare a modified resolution. (Resolution 1304) Approved 3-0
164. Authorize the executive director to sign an interagency agreement (amendment 7) with the state of Washington for the Bellingham Bay Demonstration Pilot project? The $425,000 in Model Toxics Control Act funding will be spent for Squalicum Creek habitat restoration, Little Squalicum Beach restoration and eel grass seeding and monitoring in the G-P log pond. The Bellingham Bay Demonstration Pilot project was initiated in 1996 with a completion date of 6/30/02. This amendment extends the deadline to 6/30/2013. Total grant money for the Bellingham Bay Demonstration Pilot project is $1,444,256 of which $602,166 has be spent. (Action Item 2) Approved 3-0
165. Authorize the executive director to sign a $19,910 contract (amendment #1) with Coast & Harbor Engineering of Edmonds for limited sediment sampling/testing and a preliminary engineering design report for the Little Squalicum Beach improvement project? The work is being done on the northwesterly bank of the artificial shoreline adjacent to Mt. Baker Plywood. The original contract was approved at the 4/5/2011 meeting, vote #60. This amendment brings the total contract to $58,910. (Action Item 3) Approved 3-0
166. Authorize the executive director to award the low bid of $634,156 to Quigg Bros, Inc. of Aberdeen for the Arrowac and Bellingham Shipping Terminal pier repair project? On 2/5/2008, a tug and barge struck a pier at the Bellingham Shipping Terminal and the Arrowac pier was damaged by wind and cold weather on 11/20/2010. The project will also install cathodic protection on the steel piles on the north and central shipping terminal center docks. A contingency fee of $63,145 brings the total contract to $697,301. (Action Item 4) Approved 3-0
167. Authorize the executive director to sign a $22,810 contract (amendment #4) with Anchor QEA of to perform subsurface investigations for the Squalicum Creek restoration project? The major components of the project are: removal of fish passage barriers, modification of two bridges, removal of the concrete bottom between the two bridges and replacement of a sewer trunk line. The state, city of Bellingham and Whatcom County have made commitments of $2,085,000 to fund the project. The estimated cost of the project is $3,500,000. The amendment brings the total contract to $507,460. (Action Item 5) Approved 3-0
168. Authorize the executive director to sign a membership agreement joining the King County Directors’ Association? The association is a non-profit cooperative that was formed in 1983 by school districts in King County to save money by making volume purchases. It serves 295 public schools and has associate members in five northwestern states. There is no charge to join and it doesn’t have annual or membership fees. (Action Item 6) Approved 3-0
