Action Taken at June 7, 2011 Meeting

Shall the commission:

82. Authorize the executive director to award a $470,930 contract (amendment #1) to American Building Maintenance of New York for janitorial services? The contract is for 34 port facilities, four more than the previous contract. The previous contract plus contingency fee approved at the 6/1/2010 meeting, vote #87, was for $445,748. This contract runs from 7/1/2011 through 6/30/2012 and includes a $65,000 contingency fee for a total contract of $535,930. (Consent Agenda C) Approved 3-0

83. Authorize the executive director to award the low bid of $99,970 to Audio Video Excellence of Bellingham for 17 monitors, associated equipment and software? This purchase is part of the Bellingham airport terminal expansion project; the monitors will display, television channels, flight information, tenant advertising, art work, announcements and hosting/greeting information. When the expansion project is completed the terminal may have over 50 monitors. The equipment was advertised and two bids were received. (Consent Agenda D) Approved 3-0

84. Authorize the executive director to sign a $19,395 contract (amendment #3) with Reid Middleton, Inc. of Everett for additional hydraulic analysis and design of two water retention ponds at the Bellingham airport? The original contract was approved at the 8/17/2010 meeting, vote #123 and amended at the 2/15/2011 meeting, vote #38. The southwest pond serves two-thirds of the runway/taxiways, commercial apron, general aviation areas and one-half of the Mitchell Way development area. The work is eligible for 95 percent federal (FAA) reimbursement funding. The upgrading of the ponds allows additional development at the airport. This amendment brings the total revised contract to $288,106. (Consent Agenda E) Approved 3-0

85. Authorize the executive director to terminate an easement with the Haskell Corporation? A 1992 easement allowed the port to monitor groundwater on the property at 4th and Harris. Cleanup was required of boatyard waste and a Bunker C tank bottom under the Model Toxics Control Act. Since the property passed four consecutive quarters of groundwater, monitoring is no longer required. (Consent Agenda F) Approved 3-0

86. Authorize the executive director to award the low bid of $130,114 to Western Refinery Services of Ferndale for two projects at Squalicum Harbor and one in Sumas? The Squalicum Harbor boat launch parking lot will be will be given a sealcoat and restriped, the asphalt will the replaced at the sawtooth pier. The Teal-Jones log yard in Sumas will the repaved. The work was advertised and three bids were received. A contingency fee of $19,486 brings the total contract to $149,600. (Consent Agenda G) Approved 3-0

87. Authorize the executive director to award the low bid of $70,807 to Cummins Northwest of Renton for a trailer mounted generator? The generator is emergency power for the ferry terminal and the first phase of the airport terminal expansion project. The equipment was advertised and four bids were received. One bid was rejected because it didn’t include a trailer. (Consent Agenda H) Approved 3-0

88. Approved a shared parking agreement with the city of Bellingham and Bellwether Gate, LLC? The agreement complies with the Bellingham Municipal Code for the available supply of parking during peak and off-peak hours for Buildings A, B, C and D on Bellwether Way. (Consent Agenda J) Approved 3-0

89. Modify a lease with the federal government for tie-down spaces at the Bellingham airport? At the 12/14/2005 meeting, the commission approved a lease with the Department of Homeland Security (U.S. Customs and Border Protection) for the International Trade Building at the Bellingham airport. The five-year lease with two one-year renewal options was for 30,000 square feet of office/warehouse space, thirty additional parking spaces, 4,162 of vacant parking lot and four aircraft tie-down spaces. This lease modification adds 10 aircraft tie-down spaces for a total of 14. The federal government leased 25,000 square feet in the same building for the Olympics Coordination Center; that lease has expired. (Consent Agenda K) Approved 3-0

90. Authorize the executive director to accept a $3,786 federal grant for portable security fencing? The Department of Homeland Security grant will be used at the Bellingham Shipping Terminal. The total estimated cost for fencing, installation, shipping and sales taxes is $4,431. (Action Item 1) Approved 3-0

91. Authorize the executive director to sign amendments with Chartis, Inc., for insurance coverage of Whatcom Waterway? In 2005, the port purchase cost-cap insurance from AIG for the former Georgia-Pacific property. In 2009, the name of the property-casualty company was changed to Chartis; it is owned by AIG. In 2007, the port entered into a consent decree with the state of Washington to implement a cleanup plan for Whatcom Waterway. Phase 1 will address the inner portion of the waterway and phase 2 the cleanup of the former G-P treatment lagoon. The insurance coverage purchased in 2005 did not include the treatment lagoon. The total estimated cost of the Whatcom Waterway cleanup is $90 million. Once the cleanup is completed, Chartis will pay the port $2 million. Under the terms of the amendments, the payment could be higher or lower depending on the final cleanup costs. (Action Item 2) Approved 3-0

92. Authorize the commission president to sign a consent decree (amendment #1) for the Whatcom Waterway cleanup plan? At the 9/18/2007 meeting, vote #110, the commission president was authorized to sign the original consent decree. That plan was modified to create two distinct cleanup phases; phase 1 will address the inner portion of the waterway and phase 2 the cleanup of the former G-P treatment lagoon. The cleanup of the lagoon will allow its future use as a marina. Phase 1 and 2 cleanup is expected to take seven years. (Action Item 3) Approved 3-0

93. Authorize the executive director to sign a $35,065 contract with Argus Pacific of Seattle to provide consulting services for three buildings in The Waterfront District? At the 7/7/2009 meeting, vote #109, Argus Pacific was authorized to perform hazardous building materials survey on 10 buildings in The Waterfront District. This contract will focus on the three buildings (bleach plant, pulp screen room and pulp storage building) that will be demolished. The work will include inspection for asbestos, lead based paint, PCB-containing light ballasts, preparation of a written report summarizing the finding, design of abatement drawings and abatement oversight services. A contingency fee of $3,507 brings the total contract to $38,572. (Action Item 4) Approved 3-0

94. Authorize the executive director to award the low bid of $824,490 to Razz Construction of Bellingham for float, loading zone, dock and webhouse repairs? Recent surveys have identified electrical, structural and maintenance deficiencies requiring repairs to be performed over the next few years. The inner harbor float structural upgrades will include Gates 7, 9 and 10. The first phase of the Squalicum loading zone will focus on waterside pile caps. The Squalicum dock will focus on electrical and the timber deck. Webhouse #2 will correct and upgrade electrical service to individual lockers. A contingency fee of $82,240 brings the total contract to $906,730. (Action Item 5) Approved 3-0

95. Authorize the executive director to sign a $139,000 contract with KPFF Consulting Engineers of Seattle for the Shipping Terminal and main pier repair/replacement project? The work will involve three phases. The first, develop up to four bulkhead replacements options, repair pilings and bracing at the Shipping Terminal. The second and third phases will include permitting, bid level design and construction support. A contingency fee of $13,900 brings the total contract to $152,900. (Action Item 6) Approved 3-0

96. Authorize the executive director to increase the contingency fee for Tiger Construction by $100,000? At the 10/19/2010 meeting, vote #143, the commission approved a low bid of $7,116,515 and a contingency fee of $355,825 to Tiger Construction for phase 1 of the Bellingham airport terminal expansion project. This contingency fee increase is for work not included in the original phase 1 design. It includes: concession area work, adding media, artwork, an automatic defibrillator station and signage. This contingency fee brings the total contract to $7,574,340. (Action Item 7) Approved 3-0

97. Amend the lease with Bellwether Gate LLC for Building C at Bellwether on the Bay? The project includes four buildings, underground and surface parking areas. The lease for Building C was previously amended at the the 10/19/2010 meeting, vote #142. The construction of Building A is completed and the the construction of Building B is expected to be completed by October 2011. This amendment for Building C will change the completion date from June 2011 to June 2012. Construction of Building C is expect to start by 12/1/2011; it is a two-story building with about 10,000 square feet. (Action Item 8) Approved 3-0
