Correction

The April 6, 2009 meeting, vote number 64, incorrectly listed the motion to spend $2,500,000 to purchase three parcels of land and buildings as approved 3-0. The vote actually failed 1-2, Mike McAuley and Scott Walker opposed.

Action Taken at May 4, 2010 Meeting

Shall the commission:

68. Authorize the interim executive director to sign an agreement outlining the arrangements/commitments with eight Washington ports and sign a broker services agreement letter recognizing Alliant Insurance Services as the port’s broker of record? (Consent Agenda C) Approved 3-0

69. Authorize the interim executive director to sign a $321,756 contract (amendment #1) with SecureTrans of Seattle for security services? Guard rates are increasing 15 cents per hour and supervisor rates are increasing 16 cents per hour. The previous contract with SecureTrans was $313,465. The one-year contract runs from 6/1/10 to 5/31/11. (Consent Agenda D) Approved 3-0

70. Authorize the interim executive director to accept a state grant not to exceed $56,295 to reimburse the port for costs associated with the purchase of pump-out facilities at Berth #2? Boaters use pump-out stations to remove human excrement from their vessels. The grant reimburses costs associated with the purchase of pump-out equipment, associated infrastructure and annual operating costs. The total cost is $75,060 with the state grant covering 75 percent. (Consent Agenda E) Approved 3-0

71. Authorize the interim executive director to sign a $23,205 contract (amendment #1) with URS Corporation of San Francisco, Calif. for the taxiway “D” repair project? The original $138,685 contract for engineering and design was approved at the 5/5/09 meeting, vote number 78. The amendment covers pre-design ($5,953) and final design/construction management services ($17,252). This amendment brings the total contract to $161,890. (Consent Agenda F) Approved 3-0

72. Authorize the interim executive director to apply for $30.25 million in passenger facility charges for the terminal/lobby expansion projects at the Bellingham airport? Passenger facility charge money can only be used for airport safety and increases to airport capacity. The current charge is $4.50 per departing passenger (the Congressionally authorised limit); the airline keeps 15 cents and sends $4.35 to the port. Staff estimates it will take almost 16 years to collect $30.25 million and proposes an increase to $7 when and if it is approved by Congress. (New Business 1) Approved 3-0

73. Authorize the interim executive director to sign an agreement with the state of Washington to provide energy/utility conservation project management and monitoring services? The agreement will reduce environmental impacts associated with energy use, including greenhouse gas emissions. There is no cost for the initial audit; the intention is that any energy-saving to capital improvements will be paid for from cost-savings. (New Business 2) Approved 3-0

74. Authorize the interim executive director to sign a voluntary cleanup program with the state of Washington for the Northwest Fuel site? The Northwest Fuel site project addresses the remediation of contaminated soil and groundwater. A bulk fuel terminal operated at 2800 Roeder Avenue from the 1930s until 2007. Tenants at the site have included Shell Oil (1935 to 1969) and Northwest Fuel Company (1969 to 2004). In early 2002, Northwest Fuel merged with another company to form Transmart Petroleum. Federated Insurance will pay for ninety percent of the cleanup, $1,011,774 By entering into the cleanup program the port will be eligible for matching grants of 50 percent up to $250,000. (New Business 3) Approved 3-0

75. Authorize the interim executive director to award the low bid of $182,063 to The Franklin Corporation of Ferndale for weblocker and other building repair projects? Webhouses 1-4 will be repaired, Gatehouse 3 and Squalicum Esplanage will be painted and siding replaced. The restroom floors at Fairhaven Station will be resloped. The work was advertised and six bids were received. A contingency fee of $27,309 brings the total contract to $209,372. (New Business 4) Approved 3-0

76. Authorize the interim executive director to award the low bid of $275,368 to Razz Construction of Bellingham for improvements to the Bellingham Cruise Terminal? The project will repair the diesel fuel line, install a sewage pump-out station for SOLAS vessels and replace utility hangers under the pier. This project was budgeted at $1,000,000 over four years. Doing all the work in a single year reduces the cost. The work was advertised and three bids were received. A contingency fee of $27,536 brings the total contract to $302,904. (New Business 5) Approved 3-0

77. Authorize the interim executive director to approve a $113,000 settlement with the federal government for protest costs? At the 8/27/09 meeting, vote number 136, the commission authorized the filing of a protest with the government accountability office on the failure by NOAA to properly evaluate technical factors in the decision to relocate in Newport, Ore. The port submitted costs totalling $136,942; staff recommends accepting NOAA management’s approved amount of $113,000, since pursuing the higher figure would entail higher costs than the incremental amount gained. (New Business 6) Approved 3-0

78. Authorize the executive director to sign a $13,791 contract (amendment #3) with Cooke Scientific of Seattle for revisions to the off-site wetland mitigation report for the Bellingham airport? Cooke Scientific is a subcontractor under Reid Middleton. The revisions will finalize specifications for site preparation and planting. This amendment increases the contract to a total of $32,332. (New Business 7) Approved 3-0

79. Approve a modification of the research facility lease with Western Washington University? In October 2007, the state of Washington designated the Waterfront District as an Innovation Partnership Zone. A $1 million state grant was awarded to the port (6/17/08 meeting, vote number 91) to be used for construction of the Innovation Partnership Zone research and training facility. The port had a 10,000 square foot facility constructed in the former G-P tissue warehouse — now called the Marine Trade Center. At the 2/3/09 meeting, vote number 30, the commission approved a ten-year research facility lease with Western Washington University. This modification will permit WWU to sublet their space to the Technology Alliance Group after receiving the port’s written approval. (New Business 8) Approved 3-0

80. Approve a lease with Avamere Home Health Care d/b/a Signature Home Health in the Fairhaven Station? The lease is for Suite 325 at 401 Harris Avenue. The base rent for 3,136 square feet is $2,613 plus “triple net” charges of $914.67 per month for the first two years, increasing by 2 percent for the next three years. Thereafter, rents shall be consistent with market rates for optional consecutive five-year lease renewal periods. Revenue for the five-year lease (5/5/10 through 5/4/15) will be $157,981. (New Business 9) Approved 3-0

81. Authorize the interim executive director to award the only bid of $23,367 to SeaWestern Fire Fighting Equipment of Kirkland for the purchase of four self-contained breathing apparatus with air cylinders? An invitation for bids was issued and one bid was received. A federal grant covers 95 percent of the equipment cost. (New Business 1) Approved 2-0, Scott Walker absent.

82. Authorize the interim executive director to award the low bid of $31,222 to L.N. Curtis & Sons of Oakland, Calif for the purchase of auxiliary equipment? This equipment is for a fire truck purchased at the 3/16/10 meeting, vote number 52. That vote authorized $70,000 for auxiliary equipment. An invitation for bids was issued and three bids were received. A federal grant covers 95 percent of the equipment cost. (New Business 2) Approved 2-0, Scott Walker absent.

83. Authorize the interim executive director to spend $51,206 to purchase teak benches and tables from Westminster Teak of Live Oak, Fla. for Tom Glenn Common? The sole-source justification form listed environmentally sustainability practices for the purchase from Westminister Teak. The company only harvests eco-friendly teak from government-managed, credibly certified forests. Commissioners expressed concern about the overall attractiveness of the park (in the Bellwether complex) and requested more work on the overall plan for Tom Glen Common before spending money on furniture. (New Busines 3) Tabled 2-0, Scott Walker absent.
