Action Taken at March 2, 2010 Meeting

Shall the commission:

39. Authorize the interim executive director to sign an agreement with Black Rock Cable of Bellingham for fiber optic use at 235 Marine Drive, Blaine? The lease is for privately-owned fiber network over which the port operates its WAN (wide-area network). The two year agreement will automatically renew for another year. Cost of the renewed lease is $574.75 per month. (Consent Agenda C) Approved 3-0

40. Appropriate an additional $18,882 for the Bellingham airport lighting generator budget? This vote increases the lighting generator budget from $88,000 to $106,882. At the 8/4/09 meeting, vote number 128, the low bid of $76,341 was awarded to Larry Brown Construction of Bellingham for the generator plus a contingency fees of $7,634 for a total of $83,975. Engineering costs of $11,000 plus other recently discovered problems were not included in the original budget. The federal government is paying 95 percent of lighting generator costs. (Consent Agenda D) Approved 3-0

41. Authorize the sale of one vessel for the nonpayment of moorage fees? An auction was held on March 18 for a 30-foot fiberglass sailboat with moorage fees of $1,771 plus the contents of a web locker and a generator that were previously approved by the commission. All the items were sold and the port recovered all its expenses. (Consent Agenda E) Approved 3-0

42. Authorize the interim executive director to sign a use permit with the Bellingham Sailing Foundation to allow a sailing program to use the Zuanich Park day dock? The Bellingham Yacht Club’s Youth Sailing Program is for kids ages 8-18. The Zuanich Park dock is at the entrance of Gate 3; the permit will allow kids just learning boating to avoid the busy waterway of Gate 3. (Consent Agenda F) Approved 3-0

43. Authorize the interim executive director to sign a $108,025 contract with Pacific Survey and Engineering of Bellingham for phase four of the Bellingham airport parking lot and stormwater retention pond projects? This is planning and design services for phase IV of the parking lot expansion project. The stormwater pond is part of the stormwater master plan recently conducted at the airport. A contingency fee of $21,605 brings the total contract to $129,630. (New Business 1) Approved 3-0

44. Authorize the interim executive director to award the low bid of $192,068 to Sail Electric of Bellingham for the Bellwether traffic signal project? A traffic signal will be installed at the intersection of Roeder Avenue and Bellwether Way. An agreement with the city of Bellingham (see 7/7/09 meeting, vote number 104) requires a traffic signal or roundabout at the intersection prior to the city issuing a certificate of occupancy for a second building at Bellwether Gate. The project was advertised and four bids were received. A contingency fee of $19,207 brings the total contract to $211,275. The port estimated the project cost at $402,861. (New Business 2) Approved 3-0

45. Authorize the interim executive director to sign a $123,153 contract with Aspect Consulting of Seattle to perform engineering and design services for the Northwest Fuels demolition and remediation project? This project addresses the remediation of contaminated soil and groundwater at the Northwest Fuel site. A bulk fuel terminal operated at 2800 Roeder Avenue from the 1930s until 2007. Tenants at the site have included Shell Oil (1935 to 1969) and Northwest Fuel Company (1969 to 2004). In early 2002, Northwest Fuel merged with another company to form Transmart Petroleum. Federated Insurance will pay for ninety percent of the cleanup, $1,011,774 and 50 percent of the remaining costs can be recovered under a state grant program. Shell Oil is still liable for any remaining contamination removal costs after site remediation. A contingency fee of $13,000 brings the total contract to $136,153. (New Business 3) Approved 3-0

46. Renew a land lease with The Landings at Colony Wharf? The two-year lease for property at 1020 C Street is $4,200 per month plus a state leaseholder tax. The contract contains an early termination clause should the port require the property for environmental remediation or redevelopment. Chevron donated the property at 1020 C Street to the port; see the 11/2/04 meeting, vote number 109. The property (adjacent to property purchased by the Bellingham City Council at the 10/17/05 meeting, vote number 218) is part of the old Roeder garbage dump that may cost $1 or $2 million to clean up. (New Business 4) Approved 3-0

47. Approve a lease change from Desticon Transportation to Mountain View Reload (USA) for property located in Sumas? Desticon Transportation has been a port tenant since 1989. Mountain View Reload has purchased Desticon and is moving its Abbotsford facility to Sumas. The Desticon facility has been used for storing and loading truck and railcars operating between Canada and the United States. Mountain View hopes to expand the business from timber to steel and other building products. (New Business 5) Approved 3-0

Action Taken at March 4, 2010 Meeting

Shall the commission:

48. Authorize the human resources manager to sign a $35,000 contract with Waldron & Company of Seattle to conduct a search for a new executive director? The search will be completed in 90 days. A cost breakdown is $25,000 for fees and $10,000 for expenses. (New Business 1) Approved 3-0

Action Taken at March 16, 2010 Meeting

Shall the commission:

49. Accept a Recovery Zone Facility Bond allocation of $2,738,000 from Whatcom County and designate an area within the port as a recovery zone? The Recovery Zone Facility Bonds were created by the U.S. Congress as part of the American Recovery and Reinvestment Act. The recovery zone bonds are available to port tenants or users for financing. New Business 3 (Resolution 1282) Approved 3-0

50. Authorize the chief financial officer to pay the state auditor an estimated $33,284 for the annual audit? The estimated amount doesn’t include travel and out-of-pocket costs. (New Business 2) Approved 3-0

51. Authorize the interim executive director to accept a federal grant of $20,151,094 for a fire truck, runway 16/34 and taxiway “A” rehabilitation project? The interim executive director is also authorized to accept additional federal grants up approximately $27 million for the project. These grants will fund 95 percent of the costs of current airport projects. (New Business 4) Approved 3-0

52. Authorize the interim executive director to award the low bid of $649,018 to the Oshkosh Corporation of Oshkosh, Wisconsin, for a fire truck? This vote also authorized the purchase of $70,000 in auxiliary equipment. The truck purchase was advertised and two bids were received. A contingency fee of $32,450 brings the total contract to $681,468 and auxiliary equipment purchase to an authorized amount of $751,468, of which 95 percent will be covered by a federal grant. (New Business 5) Approved 3-0

53. Authorize the interim executive director to award the low bid of $26,341,955 to ICON Construction of Tukwila for the runway 16/34 and taxiway “A” rehabilitation project? Both the runway and taxiway will be repaired and the runway widened from 60 feet to 75 feet. The runway will be closed from midnight to 5 a.m. for five months and a completely closed for three weeks in September. The work was advertised and four bids were received. A contingency fee of $2,634,195 brings the total contract to $28,976,150. Ninety-five percent of this project will be financed by the federal government. (New Business 6) Approved 3-0

54. Ratify an agreement with the city of Bellingham to permit the use of the former G-P site for the off-loading and stockpiling of barged construction materials for the airport runway rehabilitation project? An estimated 7,700 fully loaded truck trips from the site to the airport are estimated over a five month period. If the contractor elects to use the former G-P site for storage a SEPA review will be conducted by the port. (New Business 7) Approved 3-0
