Action Taken at June 2, 2009 Meeting
Shall the commission:
82. Authorize the sale of surplus vehicles, equipment and materials? Items with an estimated value more than $1,000 are: John Deere backhoe $10,000; International fire truck $5,000; Ford truck with national boom $5,000; 20-foot bush hog mower $5,000; 10 yard dump truck $2,000; 1992 F-150 truck $1,000 and 1996 F-150 truck $1,000. The total estimated value of all surplus items are approximately $30,981. (Resolution 1268) Approved 3-0
83. Authorize the executive director to sign a memorandum of understanding with the International Association of Firefighters, Local 3266 to extend the collective bargaining agreement? The 2006 – 2008 agreement that was approved at the 8/15/06 meeting, vote number 95, is extended for one year with a 3 percent wage increase for all the hours worked between 1/1/09 and 12/31/09. The contract is extended rather than negotiated because IAFF Local 3266 is in the process of merging with the Bellingham Fire Department. (Consent Agenda C) Approved 3-0
84. Authorize the executive director to extend the contract with Whatcom Security Agency of Bellingham from 6/1/09 through 7/15/09? At the 5/5/09 meeting, vote number 71, the commission approved a security services contract with a new company, SecureTrans. Whatcom Security is familiar with 4th of July security needs and agreed to provide 26 officers at seven locations for less than $10,000. (Consent Agenda D) Approved 3-0
85. Authorize the executive director to settle an insurance claim and lawsuit over a boat fire at Squalicum Harbor? On March 7, 2008, a fire on a boat owned by Hilary and Randy Friedrich resulted in property damage and emergency response for the port. The cost to the port to repair the damage was $39,102. The port received $33,512 from the Lexington Insurance Company and $8,512 from Alliance Insurance Services. The net loss to the port was $96.12. (Consent Agenda F) Approved 3-0
86. Authorize the executive director to pay the city of Bellingham $57,239 in permit fees for the Waterfront Innovation Zone: Technology Development Center? The 10,000-square- foot project in the Marine Trades Center (formerly the Georgia-Pacifc tissue warehouse) will house Western Washington University and Bellingham Technical College marine research facilities. The contract to construct the facilities in the Marine Trades Center was approved at the 3/3/09 meeting, vote number 45. (Consent Agenda I) Approved 3-0
87. Authorize the executive director to spend $83,996 to purchase furniture for Squalicum Harbor? Benches, trash receptacles, t-z arms and replacements slats will be purchased from Sitelines Park and Playground Products of Everett for $69,572 and tables and benches will be purchased from Parkforms of Portland, Ore., for $14,424. (Consent Agenda J) Approved 3-0
88. Authorize the executive director to award the low bid of $321,952 to American Building Maintenance of New York for janitorial services? This contract is for 28 port facilities, new to the contract is the Olympic Coordination Center and Technology Development Center. The contract was advertised and five bids were received. The contract runs from 7/1/09 through 6/30/10 and includes a $64,390 contingency fee for a total of $386,342. (Consent Agenda K) Approved 3-0
89. Revise the visitor moorage rates? The moorage rates for visitors will increase for April through October from $.50 a foot per night to $.75 a foot per night. The Marine Advisory Committee unanimously endorsed the rate increase. The November through March rates will remain at $.50 a foot per night. Visitors rates were last increased in 1998. The proposed rate will increase port income by approximately $32,000 per year. (Consent Agenda L) Approved 3-0
90. Modify a lease with Point Roberts Press? At the 6/7/05 meeting, vote number 72, the commission approved a 40-year lease with Point Robert Press. The lease allowed Point Roberts Press to construct a two-story building at 225 Marine Drive in Blaine. Phase 1 would demolish the existing building on the site and construct the first story; construction was to start in 90 days and be finished in one year. Phase 2 would construct a second story and construction would commence by 6/1/09. Due to current economic conditions, Point Roberts Press is requesting that construction of phase 2 be delayed until 6/1/14. (Consent Agenda M) Approved 3-0
91. Appoint Fred Seeger as the interim executive director? The resignation of the current executive director Jim Darling is effective July 10. The appointment of Mr. Seeger is effective immediately, subject to the following: he will serve as interim executive director until a new executive director is appointed or until further direction by the commission; he will have the authority delegated to the executive director by Resolution 1106-K and state law; and he will retain his responsibilities as director of facilities and receive $2,000 per month in additional compensation. (New Business 1) Approved 3-0
92. Approve the 2009-2011 collective bargaining agreement with ILWU Local 7, Clerical Division? The contract runs from 1/1/09 to 12/31/11 and contains salary increases of 3.4 percent in 2009 and 3 percent in 2010 and 2011. The short-term disability plan is being replaced by a paid time-off plan. The vacation and paid-time-off plans are combined into one plan that varies from 18 days for the first year of employment to 33 days for 15 or more years of employment. (New Business 2) Approved 3-0
93. Approve a lease with Alaska Airlines for reimbursement of flights to Las Vegas? On 6/25/09, Alaska Airlines will start nonstop service on Boeing 737-700 jets from Bellingham to Las Vegas. For a one-year period, from 6/25/09 to 6/24/10, the port will reimburse the airline $3.00 per enplaned revenue passenger flying from Bellingham to Las Vegas. Port staff recommended the reimbursement to assist Alaska Airlines in their marketing of this new destination. (New Business 3) Approved 3-0
94. Authorize the executive director to accept a $1,525,968 federal grant for north terminal apron repairs repairs at the Bellingham airport? At the 5/19/09 meeting, vote number 81, the commission approved a $1,370,693 contract with Interwest Construction for the repair work. (New Business 4) Approved 3-0
95. Authorize the interim executive director to sign a $163,203 contract (amendment 1) with Myers General of Bellingham for an air flow system at the Technology Development Center? Myers General is constructing facilities to be occupied by Western Washington University. The university is developing a light-weight compost material that could be used in the manufacture of cars, boats and trucks. The chemicals and material being used are known carcinogens and require spacial environmental control. The air flow system that being installed is a state-of-the-art dust and fume control system. The system was not part of the original design as it was beyond the port’s budget. The combination of a low bid and additional grants has allowed the installation of the air flow system. This amendment brings the total contract to $1,248,203. (New Business 5) Approved 3-0
96. Authorize the interim executive director to sign a $25,460 contract (amendment 2) with RMC Architects for design services at the Technology Development Center? Amendment 1 redirected fees from the original contract approved at the 9/2/08 meeting, vote number 111, for the air flow system. This amendment adds additional funds for construction administration services. This amendment brings the total contract to $220,460. (New Business 6) Approved 3-0
97. Authorize the interim executive director to award the low bid of $118,265 to Ebenal General of Bellingham for “F” Street utilities extension and Gate 8 and 9 sewer extensions? The “F” Street utilities will serve the Technology Development Center with sewer, water and gas. Two sewer lines will serve new sewer pump-out stations at Gates 8 and 9. The work was advertised and six bids were received. (New Business 7) Approved 3-0
