Action Taken at May 5, 2009 Meeting

Shall the commission:

70. Delegate administrative authority to the executive director to obtain funding for overtime and repairs to facilities damaged by December 2008 winter storms? In March 2009, President Barack Obama authorize a federal disaster declaration for 33 Washington counties, including Whatcom County. The Port of Bellingham is eligible for federal reimbursement for 75 percent of overtime costs and for repairs to facilities that were damaged by the December storms. (Resolution 1267) Approved 3-0

71. Authorize the executive director to award the low bid of $313,465 to SecureTrans of Seattle for security services? The contract for the previous year was $308,952. The work was advertised and three security firms submitted bids. The one-year contract runs from 6/1/09 through 5/31/10. The contract includes a $20,000 contingency fee for a total contract of $333,465. Approved 3-0

72. Authorize the executive director to award the low bid of $64,883 to Liquid Applications of Lynden for multiple painting projects? Three port facilities will be painted: the port maintenance building on Cornwall Avenue, exterior timbers at the Squalicum esplanade and the Blaine boardwalk handrail. The work was advertised and three bids were received. The contract includes a contingency fee of $13,117 for a total contract of $78,000. Approved 3-0

73. Authorize the executive director to sign a $71,341 contract with Grette Associates of Tacoma for mitigation monitoring at Drayton and Blaine harbors? State and federal permits for moorage expansion and dredging required monitoring from 1998–2010. Grette Associates has performed the monitoring since 2002. The contract includes a contingency fee of $3,659 for a total contract of $75,000. Approved 3-0

74. Authorize the executive director to spend $32,422 to purchase security-related equipment for the new rescue and fire fighting station at the Bellingham airport? Security equipment for the newly constructed station includes: four surveillance cameras, linking the cameras to the existing port system, associated hardware and circuits. The equipment will be purchased from Aronson Security Group of Seattle and they will do the installation. The contract includes a contingency fee of $3,578 for a total contract of $36,000. Approved 3-0

75. Authorize the executive director to sign a permit with the state of Washington to allow the installation of groundwater gauges for Bellingham airport wetland mitigation? Two surface water gauges and three shallow groundwater gauges will be installed and land surveyors allowed access to state property (Tennant Lake State Wildlife Area) along the north side of Slater Road, east of the Nooksack River. Enhancement of the wetlands on this site will allow 8.9 acres of wetlands on the east side of the airport to be filled. Approved 3-0

76. Approve a lease with the state of Alaska for continued use of Bellingham as the terminus for the Alaska ferry? The original 20-year lease was signed in 1989. The new 15-year lease will run from 10/1/09 through 9/30/24. The state of Alaska is currently paying a base rent of $100,000. The new base rent for years one and two will be $517,000, year three will be $532,510 with annual increases of 3 percent for years 4–15. The state of Alaska is currently paying annual operating costs of $109,318. The new operating cost for the first year will be $259,293 and escalate 3 percent annually. The total 15-year income for the port will be $14,511,364. Approved 3-0

77. Authorize the executive director to sign a subrecipient agreement with the Washington Public Ports Association for a $240,000 grant to be used for construction of the Innovation Partnership Zone: Technology Development Center? At the 4/7/09 meeting, vote number 65, the commission authorized the executive director to sign the agreement with the Washington Public Ports Association. An education program to be created by the port was a condition of the grant. The education program language was not part of the original agreement; this amendment corrects that error. Approved 3-0

78. Authorize the executive director to sign a $138,685 contract with URS Corporation of San Francisco, Calif., for engineering and design of the taxiway “D” repair project? The pavement on taxiway “D” between taxiways “E” and “A” is failing and needs to be repaired. Pre-design for $39,874 will be funded locally, final design and construction management for $98,811 will be funded by a federal grant. Approved 3-0

79. Adjust previously approved weblocker definitions and rates? Rates and assignment classifications will be adjusted for webhouse tenants who do not meet the active commercial fishing criteria, the effective date is 1/1/10. All other categories and rates will be effective 6/1/09, as approved at the 1/6/09 meeting, vote number 12. Approved 3-0


Action Taken at May 19, 2009 Meeting

Shall the commission:

80. Authorize the executive director to sign a $78,000 contract (amendment #15) with Anchor Environmental of Seattle for the Whatcom Waterway cleanup and marine project? This amendment includes further evaluations of the proposed National Oceanographic and Atmospheric Administration facility, seismic evaluations of the shipping terminal pier, mooring configurations and an overall cost estimate review. NOAA tasks are covered under phase 2 (approved at the 11/4/08 meeting, vote number 128) of the Whatcom Waterway project. A contingency fee of $7,800 brings this amendment to $85,800 and the total contract to $5,366,487. Approved 3-0

81. Authorize the executive director to award the low bid of $1,370,693 to Interwest Construction of Burlington for for alternate #3 to repair the Bellingham airport terminal apron? At the 6/17/08 meeting, vote number 88, IMCO General was awarded the contract for the base bid and alternates #1, #2, #4 and #5; alternate #3 was waiting a federal grant to be awarded. The federal American Recovery and Reinvestment Act of 2009 will reimburse the port 100 percent of the alternate #3 base bid, but not the contingency fee. The repair work was advertised and 10 bids were received. A contingency fee of $139,307 brings the total contract to $1,510,000. Approved 3-0
