Action Taken at April 7, 2009 Meeting

Shall the commission:

53. Allow EPOD Solar of Kelowna, British Columbia, to sell up of $10 million in tax-exempt industrial revenue bond to finance an expansion? The tax-free bonds are being used as an enticement to get EPOD to build a solar panel manufacturing plant in Whatcom County. EPOD Solar will be solely responsible for repayment of the debt and will pay the port a $1,000 application fee and a one-tenth of 1 percent annual fee for servicing the loan. (Industrial Development Corporation Resolution 66) Approved 3-0

54. Delegate administrative authority to the executive director to sign interlocal agreements for the use of port property for training purposes? The port has interlocal agreements with police, fire and other emergency agencies that allow them to conduct training exercises on port property. This year, all existing and new contracts will be amended to include liability insurance provisions to protect the port. The delegation of powers in Resolution 1106K (approved at the 1/6/09 meeting, vote number 2) doesn’t include interlocal agreements. (Resolution 1265) Approved 3-0

55. Support Industrial Development Corporation Resolution 66 allowing EPOD Solar of Kelowna, British Columbia, to sell up to $10 million in tax exempt industrial revenue bonds? See vote number 53 for details. (Resolution 1266) Approved 3-0

56. Authorize the sale of five vessels for the nonpayment of moorage fees? The five vessels owe a total of $9,400 in moorage fees. A moorage fee of $1,200 on a 25-foot sailboat was paid. An auction was held on April 30 for the four remaining vessels — none were sold. The J.G. Murphy Company in Kenmore will auction a 24-foot sailboat with unpaid fees of $1,594; a 24-foot sailboat with unpaid fees of $2,112; a 28-foot sailboat with unpaid fees of $2,009 and a 52-foot commercial seine boat with 14 crab pots and unpaid fees of $2,484. Approved 3-0

57. Authorize the executive director to sign a $52,883 contract with TEC, Inc. of Charlottesville, Va., to perform consulting services for the port’s environmental compliance assessment program? The program began in 1992, when the port started looking more closely at the impact of the port and tenant operations on port properties. This contract addresses stormwater regulations related to National Pollution Discharge Elimination System phase II municipal stormwater permit. Through the environmental compliance assessment program, the port provides stormwater education to tenants as well as illicit dischage detection and stormwater catch basin labeling. The contract runs from 4/1/09 through 3/31/10. Approved 3-0

58. Authorize the executive director to spend $134,821 to purchase a boom truck, a crane and its installation? An International 7000 (cab and chassis) will be purchased for $67,691 from Cascadia International of Tacoma. The crane will be purchased from and installed by Northend Truck Equipment of Marysville for $67,130. The new truck and crane replace a 1983 Ford boom truck that needed extensive repairs to meet state certification. Approved 3-0

59. Authorize the executive director to sign a $15,280 contract (amendment 3) with Rosario Archaeology of Bellingham for archaeology screening at the Bellingham airport? The U.S. Army Corps of Engineers requires an archaeology screening before issuing an airport wetland fill permit. The first amendment added screening at the Blaine boat launch and the second amendment was for a detailed investigation of the site adjacent to the former Washington Air National Guard site. This amendment will increase the total contract to $39,437. Approved 3-0

60. Authorize the executive director to settle a damage claim against Salmon Bay Barge Line? On 3/4/07, a Salmon Bay tug with a barge struck berth #3 at the shipping terminal damaging the pier. The damages were repaired by General Construction (approved at the 9/2/08 meeting, vote number 110) at a cost of $7,196. The port has been paid in full for the damage claim. Approved 3-0

61. Authorize the executive director to settle damages claims against Chris and Posi Beaudin and Mark Mackiewicz? On two separate occasions in November 2007, the improper tying of two vessels by the two moorage customers resulted in significant damage to the docks at Squalicum Marina. It cost the port $20,787 to repair the damage. The port has been paid in full for both damage claims. Approved 3-0

62. Authorize the executive director to settle damages claims against Western Towboat Company and K-Sea Transportation? On 4/4/06, a Western Towboat Company tug and barge struck berth #3 and damaged the pier. On 4/26/06, a K-Sea Transportation tug and barge struck berth #1 at the shipping terminal damaging the pier. It cost the port $14,670 to repair the damage. The port has been paid in full for both damage claims. Approved 3-0

63. Authorize the executive director to sign a sworn statement in proof of partial loss with the Lexington Insurance Company? On 2/5/08, a tug struck berth #3 at the shipping terminal resulting in $223,124 in damages. The port expects to receive $198,124 minus a $25,000 deductible, from the Lexington Insurance Company, its insurance carrier. Approved 3-0

64. Award three grants totaling $50,000 to the cities of Blaine, Sumas and Everson? The port started the small cities economic developments grants in 2004. The city of Blaine will receive $33,000 for the construction of Boblett Street across the former airport; the project is receiving federal money and the city is providing $369,000 for construction of the road. The city of Sumas will receive $7,000 for the resurfacing of Bob Mitchell Avenue originally built by the port; the project is receiving federal money. The city of Everson will receive $10,000 for street and drainage improvements in the Wellhead Protection Area; the city will contribute matching money. Approved 2-0, Jim Jorgensen recused.

65. Authorize the executive director to sign a sub-recipient agreement with the Washington Public Ports Association for a $240,000 grant to be used for construction of the Innovation Partnership Zone: Technology Development Center? The money was originally a federal grant to the Washington Public Ports Association to be used by small ports on economic development. The Washington Public Ports Association will retain $8,000 to perform grant administration. Approved 3-0

66. Modify the lease with Allegiant Air to add marketing expenses reimbursement for flights to Los Angeles, California? For a one-year period beginning 5/2/09, the port will reimburse the airline $3.00 per enplaned revenue passenger flying from Bellingham to Los Angeles. Approved 3-0

67. Authorize the executive director to sign a $44,200 contract with Landau Associates of Edmonds to perform a baseline site assessment of inactive tank farm sites? Starting in the 1930s, several properties located near the intersection of Roeder Avenue and Squalicum Parkway were operated as bulk fuel fueling facilities by Atlantic Richfield, EXXON and Yorkston Oil Company. An environmental site assessment completed in 2002 determined that the bulk fueling activities resulted in petroleum and hydrocarbons in the soil and groundwater. The properties are on the state list of hazardous sites. The baseline site assessment will be conducted to develop an improved understanding and documentation of the site history and environmental site conditions. A contingency fee of $4,420 brings the total contract to $48,620. Approved 3-0

68. Authorize the executive director to award the low bid of $130,200 to Advanced Construction of Mukilteo, to replace windows, gutters and floors at the Fairhaven Station? In 1994, the Pacific American Fisheries office building was converted to a bus/train station. Wood windows were utilized in the 1994 remodel to preserve the historical character of the building. This project replaces 38 windows in the building, paints the exterior of 19 windows, replaces 1,200 lineal feet of gutters and refinishes the tile floors. The work was advertised and seven bids were received. A contingency fee of $13,020 brings the total contract to $143,220. Approved 3-0

69. Adopt the proposed planning framework and planning assumptions? This vote will move the waterfront redevelopment master plan process forward. It will further planning development and public review, including referral to the Waterfront Advisory Group. A final decision will be made after the publication of the final environmental impact statement. Approved 3-0
