Action Taken at March 3, 2009 Meeting

Shall the commission:

34. Increase the 2009 strategic (operating and capital) budget and property tax levy? At the 11/18/08 meeting, vote number 132, a preliminary budget was approved. Since that meeting the port was notified of the newly assessed valuation of its properties by the county assessor. This vote increases the property tax levy by $66,154 or 0.9 percent over 2008 but decreases the assessed rate from $.3246 in 2008 to $.3060 in 2009. (Resolution 1262A) Approved 3-0

35. Increase the 2009 property tax levy? When the levy was approved at the 11/18/08 meeting, vote number 133, the port had not received notification of assessed valuation. As the property tax levy is based on the assessed property valuation, the amount in the adopted budget must be modified to reflect the new assessment. The increase in the assessed value results in a tax levy of $7,423,308 ($216,213 larger than the 2008 property tax levy). This vote adjusts tax levy. The maximum tax levy the commission could assess for 2008 is $8,368,058. (Resolution 1263A) Approved 3-0

36. Authorize the executive director to pay the state auditor up to $33,284 for the annual audit? The port paid approximately $28,000 for audit services in 2008. The auditor’s office estimates it will take 424 hours hours to complete the audit. The above amount doesn’t include cost of travel and out-of-pocket costs that are budgeted at $54,500. Approved 3-0

37. Renew a lease with Northwest Discovery Project? The port is contributing $30,500 for education and support services and $5,500 for repairs and maintenance, a $6,000 increase over 2008. In 1995, the port entered into a yearly agreement with the Northwest Discovery Project to operate the Marine Life Center. Since 2005, the center has charged admission to be used for operation, maintenance and repair. The Marine Life Center had approximately 23,000 visitors in 2008 of which 1,900 were students. The port supports the Northwest Discovery Project’s goal of building a terraquarium, a state-of-the-art aquarium. The lease runs from 1/1/09 through 12/31/09. Approved 3-0

38. Authorize the executive director to sign a research facility lease with the Bellingham Technical College? In October 2007, the state of Washington designated the Waterfront District as an Innovation Partnership Zone. A $1 million state grant was awarded to the port (6/17/08 meeting, vote number 91) to be used for construction of the Innovation Partnership Zone research and training facility. The port will construct a 10,000 square foot facility in the former G-P tissue warehouse — now called the Marine Trade Center. The construction budget is estimated at $1,420,500 and includes a federal grant. Starting on 1/1/12, the Bellingham Technical College will pay the port yearly rent of $1.20 a square foot, escalating by 4 percent annually, plus utility charges. Approved 3-0

39. Authorize the executive director to sign a $65,615 contract with Entrance Controls of Tukwila for phase three of the Bellingham airport parking lot expansion project? The contract covers the relocation of equipment from the temporary site to entrance and exit lanes at the new phase three site, the purchase of new equipment and a software upgrade. This is a sole-source purchase. Approved 3-0

40. Authorize the executive director to sign an $18,006 contract with Anchor Environmental of Seattle to complete the remedial investigation/feasibility study of the I&J Waterway? At the 11/16/04 meeting, vote number 117, the commission approved a $249,470 contract with the Retec Group of Seattle for a remedial investigation/feasibility study of the I&J Waterway. Retec completed 90 percent of the work in 2006. In 2007, the state temporarily suspended the project pending clarification of the dredge management program. Retec reorganized and is not available to continue the study. A 10 percent contingency fee brings the total contract to $19,807. Approved 3-0

41. Authorize the executive director to sign an $84,815 contract (amendment #3) with AECOM (formerly Retec/ENSR) of Los Angeles, Calif., to finalize the remedial investigation/feasibility study of the central waterfront site? At the 6/6/06 meeting, vote number 69, the commission approved a $386,356 contract with the Retec Group for a remedial investigation/feasibility study of the central waterfront. A $214,995 amendment was approved at the 9/5/06 meeting, vote number 98. The draft report was submitted to the state in October 2008. This contract addresses comments by the state on the draft report. Amendment #3 brings the total contract to $698,156. Approved 3-0

42. Authorize the executive director to sign a $12,000 contract with Reed Stoops & Associates of Juneau, Alaska, for Alaska Highway System issues? The goal of the contract is the maintenance of ferry service from Alaska to the Bellingham Cruise Terminal. Approved 3-0

43. Amend the design agreement and lease with Bellwether Gate LLC? At the 6/17/08 meeting, vote number 92, the commission approved plans and specifications for Bellwether Gate: four buildings to be constructed near Bellwether by the Bay. Financing the construction is taking longer than originally anticipated. This amendment extends the design agreement and lease to 5/31/09. Approved 3-0

44. Formalize the name of the Innovation Partnership Zone facility as the Waterfront Innovation Zone: Technology Development Center? The 10,000 square foot project in the Marine Trades Center (formerly the Georgia-Pacifc tissue warehouse) has been called the Applied Research and Technical Training Facility, the Marine Trades Center Innovation Facility and leases have been signed for a reseach facility. The shorthand name will be WIZ Center. Approved 3-0

45. Authorize the executive director to award the low bid of $986,129 to Myers General of Bellingham for the Waterfront Innovation Zone: Technology Development Center? Myers General will construct separate facilities to be occupied by Western Washington University (approved at the 2/3/09 meeting, vote number 30) and Bellingham Technical College (see vote 38) and a common area. The work was advertised and 11 bids were received. The highest bid was $1,602,220. A contingency fee of 15 percent brings the total contract to $1,085,000. Approved 3-0

46. Authorize the executive director to award the low bid of $166,982 to Bellingham Marine Industries of Bellingham for the Blaine boat launch replacement project? The port received a state grant of $104,995 (see 2/3/09 meeting, vote number 24) for the project. Treated pilings will be replaced with concrete pilings, concrete floats will be replaced and two new street lights will be installed. The work was advertised and eight bids were received. The highest bid was $250,755. A 15 percent contingency fee brings the total contract to $192,000. Approved 3-0

47. Authorize the executive director to sign a $474,952 contract with URS Corporation of San Francisco, Calif., for phase 1 of the Bellingham airport terminal conceptual design and passenger terminal expansion project? A passenger terminal study recommended an expansion and upgrade to accommodate current and future passengers. A 10 percent contingency fee brings the total contract to $525,000. Approved 3-0

48. Approve a lease modification with Puglia Engineering d/b/a/ Fairhaven Shipyards? This modification will allow Fairhaven Shipyards to expand into the former Arrowac Fisheries cannery building and related property. With the recent acquisition of a dry dock, Fairhaven Shipyard is adding approximately 50 new jobs and needs additional office and facility space. Approved 3-0

Shall the commission

49. Authorize the executive director to to sign an amended lease with Bellwether Gate LLC? At the 6/17/08 meeting, vote number 92, the commission approved plans and specifications for Bellwether Gate. At the 3/3/09 meeting, vote number 44, the commission extended the design agreement and lease to 5/31/09. The reason for this amendment is the developer’s decision to remove residential units from building A. Approved 3-0

50. Authorize the executive director to award the low bid $1,038,345 to Ebenal General of Bellingham for the 2010 Olympic Coordination Center? There will be 28,835 square feet of tenant improvements in the International Trade Building at the Bellingham airport. See the 1/6/09 meeting, vote number 14, for details on the lease with the federal government. The work was advertised and seven bids were received. The highest bid was $1,292,259. A contingency fee of 10 percent brings the total contract to $1,142,000. Approved 3-0

51. Authorize the executive director to pay the city of Bellingham $32,052 for sewer and water permit fees for the 2010 Olympic Coordination Center? The building has a fire sprinkler system and three water meters; a water meter is required for the new restroom. Approved 3-0

52. Authorize the executive director to sign a contract for $155,275 (amendment #7)1 with WH Pacific (formerly W & H Pacific) of Bothell for engineering and consulting services related to the the Bellingham airport north apron reconstruction project? This vote also approved amendment #6 for $24,301. This vote brings the total contract to $1,022,187. Approved 3-0

1The original contract was approved at the 7/5/06 meeting, vote number 81, for $346,445 and a 10 percent contingency fee for a total of $382,000. Amendment #1 was for $34,548. Amendment #2 was approved at the 7/3/07 meeting, vote number 87, for $235,698 and a 10 percent contingency fee for a total of $259,267. Amendment #3 was approved at the 10/2/07 meeting, vote number 116, for $142,530 and deleted $153,094 in tasks from previous contracts. Amendment #4 didn’t involve money so commission approval was not required. Amendment #5 was approved at the 6/17/08 meeting for $491,183 and deleted $91,657 from previous contracts.
