Shall the commission:
45. Authorize the executive director to sign a $308,952 contract with Whatcom Security Agency of Bellingham? The hourly rate will increase 3 percent for guards and 4 percent for patrol supervisors. The contract for the previous year was $211,148. The addition of 485 hours a month for security guards at the Bellingham airport contributed to the increase. The one-year contract runs from 6/1/08 through 5/31/09. Approved 3-0
46. Authorize the sale of four vessels for the nonpayment of moorage fees? Moorage fees totaling $5,857 were paid for two vessels. An auction was held on April 24 for two vessels — neither was sold. A 56-foot wood vessel with unpaid fees of $2,725 is in the process of being destroyed and a 28-foot fiberglass vessel with unpaid fees of $2,450 will be auctioned by the J.G. Murphy Company in Kenmore. Approved 3-0
47. Authorize the executive director to enter into a $49,539 contract with Liquid Applications of Lynden to paint three port facilities? The facilities are: the interior of the general aviation building at the Bellingham airport; the exterior of Blaine gatehouses one and three and the exterior of the Squalicum boathouse. The contract includes a 20 percent contingency fee for a total contract of $60,000. Approved 3-0
48. Ratify the action taken by the executive director in reaction to a boat fire? On 3/7/08 at approximately 2:30 a.m. the Bellingham Fire Department responded to a fire at Squalicum Harbor involving several vessels; one sank. In order to avert potential environmental damage a marine salvage company was hired, the sunken vessel raised, all damaged vessels were removed from the scene and the area cleaned up at a cost of $16,314. Approved 3-0
49. Award three grants totaling $40,000 to the cities of Everson, Ferndale and Lynden? The port started the small cities economic developments grants in 2004. The city of Everson will receive $10,000 that will go towards acquisition of Burlington Northern right-of-way property; the city of Ferndale will receive $15,000 for professional services to update a 2001 business survey and a 2002 economic development plan and the city of Lynden will receive $15,000 for a retail market analysis to assist local business. Each city will contribute matching funds. Approved 3-0
50. Authorize the executive director to sign a contract not to exceed $50,000 with Martin Associates of Lancaster, Pa., for an economic impact study? The study will measure the job, income, business revenue and tax payments to the area economy by the marinas, cruise terminal, real estate tenants and airport activities for the base year 2007. Martin Associates will design four models that can be updated regularly; they will be used to educate officials and the public about the port’s contributions to the local economy. Approved 3-0
51. Authorize the executive director to spend $60,688 to replace a primary power feed? Georgia-Pacific is decommissioning the mill and will demolish the main electrical substation. The equipment to replace it will take eight to ten weeks to fabricate allowing delivery of the equipment before the replacement project is put out for bid. The contract includes a 10 percent contingency fee for a total contract of $66,688. Approved 3-0
52. Authorize the executive director to sign a $92,621 contract with KPFF Consulting Engineers of Seattle to perform structural and electrical engineering design work for three projects? The projects are: repair two sections of the Bellingham Shipping Terminal pier that was damaged by four collisions; replace a float that is deteriorating at the Blaine boat launch and address maintenance issues at the Squalicum inner harbor to keep floats and their utilities in operation for at least another 15 years. The contract includes a contingency fee of $10,379 for a total contract of $103,000. Approved 3-0

Shall the commission:
53. Authorize the executive director to sign a $399,000 contract (amendment #6) with CollinsWoerman Consulting Group of Seattle for The Waterfront District planning and to complete the draft master plan? This proposal covers Task 3 ($160,000): master plan; Task 6 ($164,000): infrastructure cost estimating and Task #7 ($75,000): sustainable development which will be included in the final environmental impact statement. The total contract amount shall not exceed $1,856,289. Approved 3-0
54. Increase the 2008 budget by $180,000 to cover legal expenses to defend Bellwether II permits? Four buildings are planned for Bellwether Penninsula. The conceptual design for this development includes building heights that are higher than those permitted by contract with the city, but in keeping with the city’s Comprehensive Plan update. The port applied for an amendment to the planned development contract, raising the building height limit to 50 feet. The city approved the amendment but a group of citizens has filed appeals with the city hearing examiner and the state Shorelines Hearings Board. Approved 3-0
55. Authorize the executive director to sign a $84,464 contract (amendment #3) with Anchor Environmental of Seattle for the Whatcom Waterway cleanup and marina development project? On June 30 of this year the port will take over operation and maintenance of the G-P treatment lagoon and the associated National Pollution Discharge Elimination System (NPDES) permit. In order to comply with NPDES permit requirements the Anchor Environmental contract addresses monitoring, testing and chemical and/or operational adjustments that may be required by the state. The amendment brings the total authorized contract to $1,158,125. Approved 3-0
56. Authorize the executive director to sign a $28,880 contract (amendment #1) with K-Engineers of Lynden for electrical and mechanical upgrades at The Waterfront District Site? Georgia-Pacific is demolishing the tissue mill and decommissioning the electrical substation that powered the complex. The initial contract with K-Engineers defined the port’s electrical needs for the area and prepared initial plans and specifications for a new electrical installation. This amendment will complete plans and specifications for the electrical upgrades, perform construction management services and provide some assistance with the design for controlling the ASB monitoring equipment. The contract includes a contingency fee of $5,620 for a total revised contract of $59,000. Approved 3-0
57. Authorize $8,065,000 to refund existing revenue bonds? The port will issue revenue-refunding bonds to provide funds to refund outstanding port revenue bonds. The new bonds will carry an average bond life of 6.4 years and an average net annual interest rate of approximately 3.86 percent, and will retain the debt covenants currently in place on the refunded bonds. The port expects to realize a net savings in excess of $250,000 over the next six years. (Resolution 1255) Approved 3-0
