Action Taken at March 4, 2008 Meeting

Shall the commission:

35. Authorize the executive director to pay the state auditor up to $33,284 for the annual audit? The auditor’s office estimates it will take 424 hours to complete the work. The above amount doesn’t include the cost of travel, out-of-pocket costs and a 10 percent contingency fee. Approved 2-0, Jim Jorgensen excused.

36. Authorize the executive director to award a $25,000 contract (amendment #2) to Bering Industrial Contractors of Edmonds to correct safety concerns at the Bellingham Cruise Terminal? Three repairs under the terminal dock are required for public safety: repair insulation on the fire protection line that feeds the sprinkler system; replace a section of the fire protection line that is used for fueling the Alaska ferry and replace sections of the natural gas line that feeds the terminal. The original contract for $383,504 was approved at the 9/4/07 meeting, vote number 104; a $17,036 amendment was approved at the 2/5/08 meeting, vote number 28. This amendment brings the total contract to $425,540. Approved 2-0, Jim Jorgensen excused.

37. Ratify the action taken by the executive director for emergency waterline repairs at the Harris Avenue shipyard? Ram Construction of Bellingham repaired the leak on the port-owned portion of the fire protection system; the repair time was estimated at eight hours and the cost at $15,000. (By meeting time, the work was completed and it took 12 hours; the final cost was unknown.) Approved 2-0, Jim Jorgensen excused.

38. Authorize the executive director to sign a contract with CFO Selections of Bellevue to conduct a search for candidates to fill the chief financial officer position? The port has conducted a few interviews with applicants, but feels that a recruitment search will produce the right person for the job. The cost of the search shall not exceed $30,000 Approved 2-0, Jim Jorgensen excused.

39. Authorize the executive director to enter into an agreement with the Whatcom Council of Governments for representation in Olympia on transportation matters? During the last few years, the port has opted not to participate in the Council of Governments agreement and has instead been represented in Olympia by the city of Bellingham’s lobbyist. The city is now hiring its own representative and the service is no longer available to the port without a fee. Participating with the Council of Governments will enable the port to apply for state funding to build a gateway into the wharf district in Blaine, the cost of which is estimated at $900,000. A state grant could pay as much as $720,000 of the project. Approved 2-0, Jim Jorgensen excused.

40. Authorize the executive director to sign a $68,323 contract (amendment #2) with ENSR (formerly The Retec Group) of Westford Mass., to complete the remedial investigation/feasibility study for the Central Waterfront site? Based on the results so far, the state is requiring additional sampling. The Central Waterfront is located between the I & J Waterway and Whatcom Waterway and is one of the sites acquired by the port under the Georgia-Pacific agreement. The site requires remedial action under the state Model Toxics Control Act and is part of the Bellingham Bay Demonstration Pilot project. The original contract for $424,991 was approved at the 6/6/06 meeting, vote number 6, and an $120,000 amendment approved at the 12/18/07 meeting, vote number 138. This amendment brings the total contract to $613,314. Approved 2-0, Jim Jorgensen excused.

Action Taken at March 18, 2008 Meeting

Shall the commission:

41. Authorize the executive director to sign a $55,000 contract (amendment #1) with Anchor Environmental of Seattle to determine the impacts of storm waves on Whatcom Waterway? Instruments on the sea floor will monitor waves and currents to determine their impacts on the dredging of contaminated sediments, placement of capping material and stability of the cap. This amendment is within the contingency fee of the original $1,073,661 contract approved at the 1/8/08 meeting, vote number 17. Approved 3-0

42. Authorize the executive director to sign a $69,000 contract (amendment #2) with David Evans & Associates of Bellingham for revisions to phase 3 and 4 design and permitting work for the Bellingham airport parking lot expansion project? Phase 3 will add an additional 870 spaces; it will bring the three phases to 1,316 spaces and a grand total of 1,931. Phase 4 originally anticipated an additional 400 to 600 spaces. This revision will add another 130 – 150 parking spaces. The original contract for $226,664 was approved at the 6/5/07 meeting, vote number 80 and amendment #1 for $278,500 was approved a the 8/21/07 meeting, vote number 98. The total amended contract is $522,500. Approved 3-0

43. Authorize the executive director to sign a $25,000 contract (amendment #2) with Friberg Construction Company of Ferndale for phase 2 of the Bellingham airport parking lot improvement project? Due to the immediate need for repairs and maintenance to airport taxiways and apron the parking lot contractor will perform the work. The damage was caused by age, heavy usage and the winter freeze-thaw cycle. The original contract was approved at the 7/17/07 meeting, vote number 89, and amended at the 12/4/07 meeting, vote number 133. The total amended amount is $1,901,580. Approved 3-0

44. Authorize the executive director to enter into a $2,500 contract (amendment #3) with RMC Architects of Bellingham for additional consultation services to complete the draft plan for area 1 of the Waterfront District? RMC Architects is currently evaluating redevelopment options (see 11/6/07 meeting, vote number 122) for the former Georgia Pacific tissue warehouse. This additional work will incorporate the redevelopment into the larger area master plan that is being completed by CollinsWoerman (see 8/21/07 meeting, vote number 94). The total amended amount is $38,260. Approved 3-0
