Action Taken at July 3, 2007 Meeting

Shall the commission:

84. Authorize the executive director to increase the contract with Whatcom Security Agency of Bellingham by $45,000? The contract was approved at the 4/3/07 meeting, vote number 48. The additional money will provide for another security guard at the airport to monitor increased passenger traffic. The port plans to be reimbursed for this expenditure through an amendment to the airlines lease agreements that will be presented at a future meeting. Approved 3-0

85. Authorize the executive director to execute a $61,300 contract with Landau Associates of Edmonds to finalize the remedial investigation/feasibility study of the Cornwall Avenue landfill? The port sold 49 percent of the landfill (11/15/05 meeting, vote number 111) to the city of Bellingham for $2,450,000. The property is located at the foot of Cornwall Avenue. Remedial action is required under the state Model Toxics Control Act. A draft remedial investigation/feasibility study was submitted to the state in 2003. The contract includes a 10 percent contingency for a total of $67,430. Approved 3-0

86. Authorize the executive director to award the low bid of $4,702,871 to Boss Construction Company of Bellingham, for the Bellingham airport expansion project? The work includes converting approximately three acres of grass to asphalt taxiways, constructing a deicing collection system, repairing an existing runway and replacing terminal apron asphalt with concrete. The contract is contingent upon receiving an FAA grant that will cover 95 percent of the cost. The job was advertised and three bids were received. The contract includes a 10 percent contingency for a total of $5,173,158. Approved 3-0

87. Authorize the executive director to amend a contract for $235,698 with W & H Pacific of Bothel for the Bellingham airport expansion project? The original $382,000 contract (7/5/06 meeting, vote number 81) was for design and engineering. This contract is for construction support, inspection and material testing services and includes a 10 percent contingency fee for a total of $259,267. This amendment brings the total contract to $617,698. Approved 3-0

88. Change the lease agreement with Fairhaven Boatworks to Bellingham Bay Community Boating Center? A group of small boat enthusiasts purchased Fairhaven Boatworks, changed the name to Bellingham Bay Community Boating Center and also changed the focus from a profit to a nonprofit corporation. The boating center will promote human-powered boat use on Bellingham Bay. Approved 3-0

Action Taken at July 17, 2007 Meeting

Shall the commission:

89. Authorize the executive director to award the low bid of $1,565,580 to Friberg Construction Company of Ferndale for Phase 2 of the Bellingham airport parking lot expansion project? Phase 1 — approved at the 10/9/06 meeting, vote number 107 — added 76 parking spaces to the existing 615 spaces; phase 2 will add 370 spaces; Phase 3 will add 870 spaces for a total of 1,931spaces. Phase 2 will relocate Mitchell Way; construct a stormwater detention vault and outfall adjacent to the wetland and make provisions for stormwater treatment, new street lighting, future utility conduits, a security booth and new ticket dispensers. The project was advertised and six bids were received. The contract includes a 10 percent contingency fee for a total of $1,772,138. Approved 3-0

90. Authorize the executive director to extend an agreement for state oversight of select contaminated sites? At the 3/1/05 meeting, vote number 39, the commission approved an agreement that established a program of state oversight for sites within the New Whatcom development area. The port would pay the state $100,000 per year for oversight. At the 6/14/05 meeting that amount was increased to $150,000 per year. Fifty percent of the port’s costs will be reimbursed by insurance. The amendment is extended from 8/1/07 to 8/1/09 and it makes no changes in the yearly costs. Approved 3-0

91. Authorize the executive director to execute a $68,700 contract (amendment #4) with The Retec Group of Concord, Mass., for the remedial investigation/feasibility study and the cleanup plan for Whatcom Waterway? The original contract for $274,500 was approved at the 5/3/05 meeting, vote number 61; amendment #2 for $240,938 was approved at the 3/7/06 meeting, vote number 34 and amendment #3 for $96,011 was approved at the 2/6/07 meeting, vote number 25. Retec estimates that they will need additional time to complete the cleanup action plan, helping the port in consent decree negotiations and providing pre-design consulting support. This amendment brings the total contract to $680,113 and extends the contract from 6/30/07 to 12/31/07. Approved 3-0
