Action Taken at May 2, 2006 Meeting
Shall the commission:
58. Authorize the executive director to accept a state grant of $121,484 for additional work on the Whatcom Waterway? The original $274,500 study for Whatcom Waterway remediation was approved at the 5/3/05 meeting, vote number 63; it was funded with a grant from the states Model Toxics Controls Act. At the 3/7/06 meeting, vote number 34, the commission approved a $240,934 amended contract. The $121,484 approved with this vote will be used for further remediation study, especially of the log pond. This vote extends the agreement to 12/31/06. Approved 3-0
59. Authorize the executive director to accept a state grant of $15,000 for additional work on the Harris Avenue shipyard site? The port started the remediation study in August of 2003. After the state reviewed the draft study, it requested additional sediment work, estimated at $30,000. This increases state grants for the Harris Avenue site to a total of $98,793. Approved 3-0
60. Authorize the executive director to accept a state grant of $39,350 for additional work to complete the remedial investigation/feasibility study at the Weldcraft Steel and Marine/Gate 2 boatyard site? The port started the study in July 2003, using a grant from the states Model Toxics Control Act. The water portion has been completed. At the 2/7/06 meeting, vote number 26, the commission approved a contract with Landau Associates of Edmonds to complete the remediation study. Approved 3-0
61. Authorize the executive director to sign a $52,742 contract with Rogerson Enterprises of Anacortes for the Gate 5, floats B and C meter replacement project? This is the second year in a three-year project to replace all of the aging power centers at Gate 5 floats. Last year power centers at float D were replaced. This year 32 power centers for floats B and C will be replaced. Next year float A will be completed. Additionally, 6 power centers are proposed to serve 12 small craft locations on the shoreward side of the Gate 1 main float in Blaine. The contract includes a 40 percent contingency fee of $21,000 for a total amount of $73,742. Approved 3-0
62. Approve an airport lease with SkyWest Airlines, Inc, doing business as Delta Connection? The lease is for one year from 6/1/06 to 5/31/0707 and will be automatically renewed unless one party provides notice of intent to terminate within 120 days. SkyWest will rent space in the main passenger terminal to perform ground handling, ticketing, security and office work. In the first year of the contract the airline will pay half of landing fees. In the second and additional years the airline will pay the entire fee. Approved 3-0
63. Amend the aviation division operating and capital budgets for 2006? For the remaining eight months of fiscal year, it is estimated the airport will see revenue increases of $265,000 and additional expenses of $59,000. Since the commission adopted the budget, Delta has announced service to Salt Lake City and Allegiant has added two additional weekly flights to Las Vegas. Approved 3-0
64. Authorize the commission president to sign a letter supporting a grant application by the Lummi Nation? The Lummi Nation applied for a $50,000 state grant to fund a feasibility study of a commercial fishing boat and pleasure craft marina at Gooseberry Point. Approved 3-0
65. Authorize the executive director to sign a one-year contract for $195,608 with the Whatcom Security Agency of Bellingham? This contract is an increase of $7,406 over the previous one (3/1/05, vote number 35). The contract includes a 9.7 percent contingency fee of $20,000 for a total of $215,608. The contract runs from 6/1/06 through 5/31/07. Approved 7-0

Shall the commission:
66. Send a letter to Senator Patty Murray requesting the state congressional delegation introduce legislation to adjust the boundaries of Whatcom Waterway, a federal channel? The boundary adjustment would change the channels land-use framework from a historically industrial focus to one that would include mixed-use commercial, enhanced public access and restoration of shoreline habitat. The federal channel is adjacent to the Bellingham Shipping Terminal and extends into Bellingham Bay; the federal designation would be removed from the inner portion of the channel. (Resolution 1230) Approved 3-0

Shall the commission:
67. Change the late fee policy for real estate leases? The policy will be written into new and renewing leases. This supersedes Resolution 1204 (passed at the 1/4/05 meeting, vote number 6) as it applies to real estate leases. (Resolution 1231) Approved 3-0
68. Appoint the director of real estate as the real estate broker of record? This will enable the port to become a member of the Commercial Brokers Association. (Resolution 1233) Approved 3-0
69. Authorize the executive director to sign a $386,355 contract with the Retec Group of Concord, MA for a remedial investigation/feasibility study of the Central Waterfront? The Central Waterfront is located between the I & J Waterway and Whatcom Waterway and is one of the sites acquired by the port under the Georgia-Pacific agreement. The site requires remedial action under the state Model Toxics Control Act and is part of the Bellingham Bay Demonstration Pilot project. The contract includes as 10 percent contingency fee of $38,636 for a total of $424,991. Approved 3-0
70. Approve a new lease with the Wood Stone Corporation and appropriate $970,447 for the construction of a building next to the existing Wood Stone facility? The $970,000 is state money; $850,000 is a loan and $120,447 is a grant. Work on the approximately 50,000 square feet building at the Bellingham airport is expected to begin by 9/1/06. The lease is for 75 years, with the first 40 years starting on 7/1/06 and the rest in 5-year renewal periods. Amended and approved 3-0.
71. Authorize the executive director to sign $360,000 contract with Reid Middleton, Inc. of Everett for engineering design and permitting of the Gate 3 reconstruction project? The project will replace 1,600 feet of floats, modify a shower floor, relocate a boathouse and, if possible, dredge sediments to reestablish a habitat beach. The contract requires a pre-design report, environmental permitting, final drawings, specifications and cost estimate.The entire project is expected to cost $4,570,000. This contract includes as 15 percent contingency fee of $54,000 for a total of $414,000. Approved 3-0
72. Authorize the executive director to extend the $249,924 contract with Advanced Building Services of Everett for janitorial services? This is the annual contract for janitorial work at port facilities. The contract runs from 7/1/06 through 6/30/07. The contract includes as 15 percent contingency fee of $37,488 for a total of $287,412. Approved 3-0
73. Authorize the executive director to sign a $68,400 contract with Tacoma Architectural Metals of Tacoma of multiple gutter and roof repairs? The contract includes a 15 percent contingency fee of $10,260 for a total of $76,660. Approved 3-0
74. Authorize the executive director to enter into a contract (not to exceed $58,000) with Cartwright Creative Group of Bellingham for Phase II of the Delta Connections marketing campaign? Phase I was approved at the 3/21/06 meeting, vote numbers 44 and 45. Airport parking revenue will finance this part of the marketing campaign. The contract runs from June through December 2006. Approved 3-0
75. Award three grants totaling $55,350 to the cities of Ferndale, Blaine and Sumas? The city of Ferndale will receive $30,000 to help connect La Bounty Road with Slater Road. Currently La Bounty ends at Sunset Avenue. The city of Blaine will receive $15,000 to study options for the airport property. The city of Sumas will receive $10,350 to be used for professional services during road construction. Approved 3-0
76. Authorize the executive director to sign a $23,906 contract with the Retec Group of Concord, MA for sediment sampling in the Squalicum Creek waterway? The sampling will determine the appropriate way to remove derelict creosote structures in the bay. The state will fund the sampling. Approved 3-0
