Action Taken at March 7, 2006 Meeting

Shall the commission:

32. Authorize the executive director to pay the state $30,144 for the annual audit? The state auditor’s office estimates it will take 48 days to complete the work; this includes 10 days for the federal audit and the port’s annual financial report. Travel expenses and out of pocket costs are additional. Approved 3-0

33. Authorize the sale of four vessels and the contents of two webhouse storage units for the nonpayment of moorage and storage fees? The total nonpayment charges are $10,425. The vessels are the Angel Rae, Windchaser and Anomaly. One vessel is a wooden purse seiner built in 1928 and two are sailboats. The webhouse auction was held on March 23 with no bids; the boat auction will be held on May 6. Approved 3-0

34. Authorize the executive director to sign a $240,934 amended contract with The Retec Group of Seattle for the environmental cleanup of Whatcom Waterway? The original $274,500 contract for a remedial investigation/feasibility study of Whatcom Waterway was approved at the 5/3/05 meeting, vote number 63, for a total of $515,434. The amended projects include: $80,350 to address updates to federal, state and harbor boundaries and coordinate the environmental cleanup; $35,025 to update surveys and/or bathymetric information; $58,505 for outreach to government agencies, project stakeholders and the public; $35,585 to evaluate shoreline stability, the practicality of sediment removal and the ‘expansion of’ waterfront alternatives to be evaluated; $17,504 to monitor the bottom of the log pond and organisms residing there; $13,965 for a memorandum addressing the impact of development on the shoreline of the log pond. The state Department of Ecology has agreed to provide matching funds of 50 percent for eligible work. This amended contract ends on 12/31/06. Approved 3-0

35. Authorize the executive director to sign a $228,414 contract with Tiger Construction of Everson to complete a trash enclosure project and four paving projects? These projects are to rebuild the gate 8 trash enclosure for $37,815; sealcoat and patch at gate 8 for $74,339; patch the asphalt at the maintenance shop for $25,000; pave Tom Glenn Road for $109,234; increase parking at the International Trade Building at the Bellingham airport for $86,766. The contract includes a 10 percent contingency fee of $23,586 for at total of $252,000. Approved 3-0

36. Authorize the executive director to sign a $61,000 amended contract with Reid Middleton, Inc. for the comprehensive wetland strategy at the Bellingham airport? The original contract for $439,000 was approved at the 12/19/00 meeting, amended on 6/27/03 for $40,000, 11/2/04 for $20,000 and 7/05 for $10,000 for a total of $570,000. The amended contract will demonstrate that streams near the airport are not deteriorating due to unnaturally high flows, inventory and map ditches near the airport to determine Army Corps of Engineers’ jurisdiction, conduct a cultural inventory and complete an installation plan of the proposed mitigation site, coordinate with Whatcom County in project aspects that are regulated by the county’s critical areas ordinance. Approved 3-0

37. Terminate the Sonny Foods lease at 2925 Roeder and approve a 35-year lease with Gaston Bay Development at 2925 Roeder? The lease runs from 3/1/06 to 2/28/41. The monthly rent starts at $1,256 for the land and $44.96 for the parking area. The rent will be renegotiated every five years. Gaston will renovate the building owned by Sonny Foods and sublease some space. Gaston is liable for any environmental costs that arise during construction. Approved 3-0

38. Approve a lease with Reisner Distributor for 1.23 acres at 2800 Roeder? This lease will start retroactively to 9/1/05 and expire 8/31/10. The rent will be $997 per month with an annual increase of 3 percent and renegotiated every five years. Reisner intends to use the site for wholesale fuel and to distribute lubricant. Approved 3-0

39. Approve a 35-year lease with Aviation Component Services? This lease is for approximately 1.35 acres at 3821 Williamson Way, Bellingham. Rent will be $2,318 for the first two years, $2,649 for years three and four, and $3,090 for year five. Rent will be renegotiated every five years. The tenant owns the improvements. There are two 25-year renewal options. Approved 2-0, Doug Smith abstained due to financial and personal relations with the leasee.

40. Raise the cap on the sale of tax-free bonds by B.B. Meat and Sausage Company from $4 to $7 million? The company is building a new facility in Ferndale that is twice the size of the building in Bellingham. At the 2/15/05 meeting, vote number 31, the port commission approved the sale of $4 million in tax-free bonds. (Industrial Development Corporation Resolution 59) Approved 3-0
