Action Taken at November 16, 2004 Meeting

Shall the commission:

111. Authorize the executive director to sign a statement with the Lummi Nation on Bellingham Bay and waterfront activities? The port will consult with the Lummi Nation, a long- time port partner in waterfront and bay environmental activities, as the port works through the process of acquiring, cleaning and developing the Georgia-Pacific property. Any specific projects resulting from the consultation will be brought before the commission for consideration and funding. Approved 3-0

112. Award the sole bid of $86,486 to Entrance Controls of Seattle for the purchase and installation of automated parking payment machines at the Bellingham airport? The vote also authorized $45,000 for port employees to design and install needed infrastructure. The automated system will fit into the new security system and provide patrons with the ability to pay as they exit the parking lot by credit/debit card or cash. The automated equipment will save the port $110,000 a year and pay for itself in less than 18 months. The contract includes a 20 percent contingency fee of $17,299 for a total of $103,785 and a project total of $148,785. Approved 3-0

113. Modify leases with Teal-Jones Lumber Services of Surrey,B.C., and American Wood Treaters of Abbotsford, B.C.? These modifications will allow Teal-Jones at the Sumas Business Park to move two of A.W.T.’s buildings to their Abbotsford, B.C. property and and be reimburesed by A.W.T. Teal-Jones will construct two other buildings to enhance their production line. American Wood Treaters’ remaining two buildings will continue to be rented by Teal-Jones. For additional background information, see the 8/3/04 meeting, votes 86 and 87. Approved 3-0

Action Taken at December 7, 2004 Meeting

Shall the commission:

114. Authorize the executive director to sign contracts for $945,002 to implement the 2005 employee benefits program? The contracts are: $917,743 with Regency Blue Shield ($827,685 for medical and $90,058 for dental and vision); $24,948 with Jefferson Pilot ($11,247 for life, accidental death and dismemberment and $13,701 for long-term disability); $2,311 with Health Promotion Network (family employee assistance). The 2005 benefits program will increase 10.49 percent over last year. Approved 3-0

115. Authorize the executive director to sign an agreement with the state for a remedial investigation/feasibility study for the Cornwall Avenue landfill site? The state Model Toxics Control Act requires the investigation and study. The port, city of Bellingham and state Department of Natural Resources have been named as potentially liable parties and are responsible for the cleanup. The three have retained Landau Associates for the work and the initial estimate is $50,000. The costs will be divided between the port 12.5 percent, state 12.5 percent and city of Bellingham 75 percent. Approved 3-0

116. Authorize the executive director to sign a grant agreement and contract with the state of Washington for a remedial investigation/feasibility study of the I&J Waterway site? The port and Bornstein Seafoods have been labeled as potentially liable parties for contamination at the site and are responsible for the cleanup. The grant from the Department of Ecology will fund 50 percent of the port’s share. Approved 3-0

117. Authorize the executive director to execute a $249,470 agreement with the Retec Group of Seattle for a remedial investigation/feasibility study of the I&J Waterway site? This agreement allows Retec to start work on the project and directs the appropriate payments. Bornstein’s Seafoods share (see above vote) is currently under negotiations and is expected to be finished in early 2005. Approved 3-0

118. Modify the lease with Seaview Boatyard North in Squalicum Harbor? This modification will settle back rent and contract issues that came from construction delays which were the result of port construction projects and other outside factors. It will extend the allotment time for the construction of a new 150-ton boat lift to July 1, 2005, adds the purchase of a surplus cement floating dock, and an adjustment to the rent schedule that represents a $7,491 in lost rent for the port during the extension period. Approved 3-0
