Action Taken at May 18, 2004 Meeting
Shall the commission:
53. Declare eminent domain over the Georgia-Pacific wastewater treatment lagoon and some upland property? The port will need 600 additional slips for boats in the next fifteen years. This is the only property that can get all the needed permit work done in less than twenty years. This declaration will allow the port to pursue the estimated decade long process to build a marina on the site. The marina will not be built until G-P no longer needs the property. (Resolution 1194) Approved 3-0
54. Accept a $41,172 settlement from Lexington Insurance Company of Boston, Massachusetts? The settlement will pay for the loss of mooring fenders and electrical equipment that disappeared between 2001 and 2002 when Bellingham Shipyard was engaged in selling off various assets to a number of buyers. The port is giving the insurer a subrogation receipt which transfers damage rights to the insurer and allows them to continue an investigatory effort to recover the lost property. Approved 3-0
55. Sign a collective bargaining agreement with ILUW Longshore and Warehouse Union, Local 7? The contract runs from January 1, 2004, to December 31, 2006, and gives employees a 2.5 percent raise each January 1 and expands the sick leave to include family beyond themselves or minor children. The added cost for the package will be $46,990 per year. Approved 3-0

Shall the commission:
56. Authorize the executive director to sign a deed agreement with the city of Bellingham for a new water line at the airport? The runway safety project will be adding fill over the existing line at the north end of the runway, making it too deep to maintain. A new line will replace the current line and be deeded to the city for maintenance and operations. Approved 3-0
57. Sign a five-year lease with Rainier Petroleum of Seattle? Rainier will be operating a diesel fuel storage and transfer facility for marine vessels at the Bellingham Cruise Terminal. The monthly rent will be $873.55. Approved 3-0
58. Authorize the executive director to sign an agreement with four cities for an economic development program? The port will be providing Everson, Ferndale, Lynden, and Sumas a total of $95,000 to assist with five projects aimed at improving their local economies. Approved 2-0-1. Commissioner Doug Smith abstained, as his company has had a working relationship with Socco of Everson, one of the entities that will benefit from this vote.
59. Authorize the executive director to award the low bid of $28,252 to B&B Painting Company of Bellingham to paint port facilities? Warehouse 4 at the Bellingham Cruise Terminal and boat launch restrooms at Blaine and Fairhaven will be painted. The contract includes a 15 percent contingency fee of $4,238 for a total of $32,490. The budget allotted $40,000 for painting. Approved 3-0
60. Authorize the executive director to award the lowest responsive bid of $215,327 to Advantage Building Services of Everett for janitorial services? This is the annual contract for janitorial work at 24 port facilities. This contract is 10 percent below last years contract with American Building Maintenance of Everett. The contract includes a 15 percent contingency fee of $32,299 for a total of $247,626. Approved 3-0
61. Authorize the executive director to sign a $497,216 contract with Tiger Construction of Everson to finish the first phase of the Bakerview infrastructure project? This project, at the corner of Bakerview Avenue and Airport Way, will coincide with the ports Wood Stone Corporation expansion project, see 11/18/03, vote 101. The first phase will install utilities, pave driveways for parking lots and widen Bakerview. Approved 3-0
62. Terminate a land lease with Calvin Leroy Schenk? Mr. Schenk sold his seafood processing building at Squalicum Harbor to Jeff Harman and Tom Irwin. Approved 3-0
63. Sign a 20-year land lease with Jeff Harman and Tom Irwin? They will be using the Squalicum Harbor building to construct new boats, perform minor boat repairs and boat sales. The monthly rent starts at $578.48 and increases to $638.49 in the final year of the contract. Approved 3-0
64. Renew a lease with the Fairhaven Group (aka Brenthaven) of Bellingham? The two-year renewal for the former Coors building at 300 Harris Avenue will end on February 28, 2006. The monthly rent is $7,302. Approved 3-0
65. Sign a five-year lease with the Squalicum Yacht Club at Squalicum Harbor? The rent for 3,311 square feet of land will be $161.66 plus a parking fee of $59.21 for a total of $220.87 per month. Approved 3-0

Shall the commission:
66. Authorize the executive director to sign an extension for a state grant on the Harris Avenue Shipyard study? The grant with the Department of Ecology is for a remedial investigation/feasibility study. It will not be completed by the June 30th deadline so this amendment will extend the deadline another year to June 30, 2005. Approved 3-0
