93. Authorize the executive director to enter into a $40,011 agreement with Grette Associates of Bellingham to monitor the Blaine Harbor Marina? Pacific International Engineering (PIE) was hired to monitor (through 2004) five mitigation sites required by the 1998 harbor expansion. Several staff members left PIE to form Grette resulting in PIEs desire to terminate the contact. Grette Associates will do the remaining monitoring work within the existing project budget and schedule. Approved 3-0
94. Authorize the executive director to sign a contract with Emergency One of Ocola, Florida for an airport rescue and firefighting truck? The Federal Aviation Administration recommended in its 2000 annual certification that the current fire truck (1987 Oshkosh) be replaced. The port is responsible for 10 percent or $60,000 of the cost, an FAA grant will pay the remaining $540,000. Approved 3-0
95. Sign a three-year lease with Puglia Engineering of Bellingham for a portion of the Bellingham Shipyard site in Fairhaven? Bellingham Shipyard had gone into bankruptcy and can no longer maintain its lease. Puglia will take a portion of the property for its operations along with the three port-owned cranes. The rent will be $17,375 per month (starting September 1,2002) with annual increases of 3 percent, resulting in revenues of $644,448 for the lease period. Approved 3-0
96. Sign a ten-year lease with All American Marine of Bellingham for a portion of the former Bellingham Shipyard site? All American Marine manufactures a lightweight high-speed low-wake passenger catamaran used in ferry systems. The site will almost triple Americans production and double their skilled work force to 50 by years end. The lease starts November 1,2002 and includes the rent of seven hoists in the building and will generate a revenue of $794,567 for the lease period. Improvements to the property will cost the port $67,000 and the tenant between $150,000 and $200,000. Approved 3-0

97. Authorize property and liability insurance payments of $420,120 for the period of October 1, 2002 through September 30, 2003? The rising cost of premiums has forced the port to make cuts, but it will still be $50,604 more than last year. The insurer offered to include terrorism coverage with an added premium, but it will not be renewed. The directors and officers coverage was reduced from $5 million per occurrence to $1 million per occurrence. Employees personal liability coverage while traveling outside North America on port business was dropped. Approved 3-0
98. Authorize the October 31 sale of five seized vessels for non-payment of charges? The seized vessels are the Confidence, Miss Kylnn, Alice Anne, Damifino, and the Take 5. The total money sought is $6,740. Approved 3-0*
99. Authorize the executive director to enter into an interlocal agreement with the city of Bellingham for waterfront planning efforts? The city of Bellingham is forming a waterfront planning task force, expected to cost $500,000 over the next 12 months. The port has been invited to participate as an equal partner and pay half the costs. The port is concerned about the agreements wording as to how the group will be formed. The port will participate only if the agreement is reworded to state that ten members of the community will be selected by the port and city equally. Approved 3-0
*Auction results: The owners of the Confidence and Miss Kylynn made restitution so the boats were not auctioned. The Alice Anne was not sold, the Damifino was sold for $100, the Take 5 was sold for $1,400 (balance owed on the account) and the North Pass (seized in MayJune 2002, vote 43, page 11and not sold previously) was sold for $100.

100. Change the petty cash rules at Blaine Harbor and custodianship at Squalicum Harbor? The increased activity at Blaine Harbor necessitates the petty cash fund be increased by $200 and, due to changes in work assignments, Mike Endsley will be appointed as the petty cash custodian for Squalicum Harbor. (Resolution 1170) Approved 3-0
101. Modify a rental agreement with Alpha Distributors for hanger space at the Bellingham International Airport? The length of the lease will be increased from 240 days to 360 days. Also, the contingency provision will be changed so that the lessee will now have to provide 360 days written notice of lease termination instead of 240 days. The March issue, vote 18, page 19 reported that Alpha was going to sign a 25-year lease and spend $1.5 million to build a 40,000 sq. ft. hanger at the airport. Approved 3-0
102. Authorize the executive director to award a $44,687 contract to Boss Construction Company of Mocksville, North Carolina to change the wire rope at the Bellingham Cruse Terminal? The annual crane inspection determined that the 13-year-old rope at the ferry ramp needs replacement. The ropes replacement will allow for the counterweight sheave bushings to be inspected. If the bushings need to be replaced, the commission authorized an additional $6,388 for the replacement. Approved 3-0
103. Authorize the executive director to enter into an interlocal agreement with the city of Bellingham on the Mitchell Way sewer line? To allow for future growth at the Bellingham International Airport (August 2002, page 6, votes 62, 63 and 64), the port is constructing a new sewage line and pump station. A cost analysis by the city of Bellingham shows that, after the area is fully developed, utility fees will not cover expenses. The port will pay the city $60,000 and transfer the ownership to the city. It will be the citys responsibility to run, maintain, repair and eventually replace the pump station. Approved 3-0
104. Approve and execute a conditional non-disturbance agreement with Sumas Energy, Inc. for their subtenant, Cedarprime, Inc.? This is a clarification of the lease agreement. The clarification states that the lessee shall be responsible for the removal of any structural improvements to the property at the termination of the lease. Approved 2-0-1, Doug Smith abstained. Commissioner Smith abstained because his company may soon enter into contract negotiations with the lessee.
